RFE reply not acceptable to INS--what happens?

Hi Friends!

Incase we reply to an RFE & if INS is not fully satisfied with an answer to that--do they give another RFE or deny the case? If they deny can we appeal?

Based on the response of RFE, if INS learns that one does not qualify, they might deny and one can appeal (time consuming) or request a motion to re-open the case (not so time consuming but typically works only if the petitioner strongly believes that the INS made an error; otherwise the INS may deny to re-open).

If INS wants further clarification, they might transfer the case to local INS center for interview.

if they deny the case, can you still

use EAD card and renew them to work, or need to apply H1 again?
