RFE received:Please help

Hi gurus,

The attorney finally received my RFE on saturday the 11th Dec. The RFe asks for a employement letter from current/prospective employer. The paralegal says she also wants a letter from my past company who sponsored my GC. The current employer has agreed to give me a letter. I dont know why the paralegal wants a letter from my former employer. Guys let me know your thoughts.

Letter

Letter from the first employer should not be necessary, did you file AC21 after changing jobs? Lawyer is perhaps trying to be extra cautious.

No i didnt file ac21 when i quit the 1st employer . He advised me not to do so and said we will reply if we receive RFE . If at i have to get a letter from my previous employer should it be as detailed as from the current employer.

I agree with the paralegal.
As you have not filed AC11 you'll have to get the certificate from former employer also.
 
If your 485 has been pending > 180 days, just give the new employers letter. At this point, an employment letter from the old employer doesn't matter.

I agree. My attorney told me the same thing to just submit a letter from new employer if I get rfe for evl.
 
Hi All,

Thank u all for replying to my post.

Spoke to my attorney (at last ) and he said i need to submit EVL from new employer only. He said in addition just to avoid any other question add a few pay stubs (6 months if i have all of them , else atleast for the last 3 months ). Since i am working with my current employer since July 03 he advised i also include my w2 from 2003 and tax returns as well. This will also show them he has paid me for over a year and half consistently. This will reinforce the case in case the officer decides to be a little more nosy.

what was your spouse's RFE on? or does the spouse get an RFE by default if the primary is issued an RFE?

Hi Betsy,

My spouse hasnt received the RFE. Looks like the RFE on the primary triggered the RFE message on the derivative/spouse.

EVL query

For EVL do we have to give current info ;shouldn't future info suffice.
In my case there is no AC21.
