RFE-Received it although included everything in your package?

Every time I check my email I hope to see a change of status saying that they mailed my EAD. We'll see....
Oh and they didn't seem to have any more info on my case than I get online, I really thought that they would have a little more.

At least I got to eat a big fatty breakfast at Denny's with my husband.

Payala, I am sorry to hear that, It seems to be much easier for them to just repeat what it has been said, so, dont take it so badly.
You already mailed back the RFE and it shouldnt take that long to get ur EAD, I believe.

I know I wouldn't be able to the the iEAD even if they counted from the initial RD, we just wanted to ask if we HAD to wait those 90 days after the RD of the missing info.

No time to panic yet...that will happen sometime in May.

Received RFE

sigh.. Received an RFE last week. I am SO mad at myself cos I forgot to translate my Birth Certificate :(

And the letter did say I cannot get an iEAD for the next 90 days!!!

My H1-B expires on May 10 so looks like I am in major limbo.

To help ease the pain, I made an INFOPASS for tomorrow morning. Will see what the officer has to say. I am quite sure I will not obtain anything out of the visit, but its piece of mind that I tried.. right????

Here are my timelines:

02/20/06 - I485 and I765 Mailed
02/27/06 - RD
02/28/06 - ND
03/09/06 - FP (Code 2 & 3)
03/11/06 - I485 and I765 Last updated on website (I guess they received my FP)
04/11/06 - RFE Received
04/13/06 - Mailed RFE
Waiting.....

This suck. :mad: I mean, just because they didn't look into your application earlier and found out about your missing translation, doesn't mean that you can't get an interm EAD.

However, you should not worry as your EAD should be processed in less time and good luck on that,

What is your DO?
 
OMG So many people are getting RFE's. I just wish I knew if after you get an RFE, your application just goes to the bottom of the pile or exactly what the process is. You know what I mean? OK I'm not gonna panic...not just yet.

Don't know yet what exactly is requested, I only got 4 e-mails saying that I will get one, and that it is for the I-485.
I'm guessing they want an employment letter because it is the only thing we didn't send. I thought a paystub would be enough, though.
I was SO sure that we included everything. I neurotically quadruple-checked all the packages. :rolleyes: What could they possibly want??
 
Damn! Et tu Patty? I think I am next in line... we sent 2004 tax returns (cuz we hadn't filed for 2005 by then) and only the latest paystub for the joint sponsor... looking at the trend, it looks almost certain that I will get the RFE too :mad: Only that I have kept everything ready and it shouldn't take me long to respond to them... but I HOPE we don't get an RFE :(

I'm so sorry to hear that, Patty. I didn't think you were going to get one since you included your 2005 tax returns and everything. Those emails are a pain, they put you down and they don't even tell you what they want.

Try to get that employement letter soon, it might take a while since some HR departments are very lazy. Hmm I can't really think about anything else either. If you get the generic RFE it might also be a good idea to have ANOTHER copy of your latest tax returns since no matter what you're missing, they request it..

I thought of another possibility: Maybe they requested another copy of our marriage certificate, because the one we sent was a preliminary one. They sent us the real, official one 2 weeks after we sent the AOS package. I remember that our judge said that only the official one would be proof of name change. Since I changed my last name to my husband's, maybe they now want to see the real marriage certificate.

Oh well, I guess it is more likely that I will get an RFE requesting the same things as yours. Looks like they send it out to just everybody!

Yeah, I think if you respond the next day, it won't delay your case so much at all. Unfortunately, we haven't requested an employment letter yet. My husband was so sure that it wouldn't be needed.

Oh, thinking of it now, he got promoted and changed his contracting company, still working for the same company though. But since he gets paid by the new contracting company, it will be considered a different employer, right? So, if USCIS requests an employment letter, does this mean, we will have to complete a new 864?

Haha, am I confusing you guys? :p

Doesn't necessarily mean that you will get one too. I mean, I still believe that they wouldn't send an RFE if they had everything they needed. Besides, you got everything else faster than I did, so maybe they spared you! :D
I will let you know what they requested. As payala says, if it's the generic RFE, you can prepare yourself and reduce the delay.
 
If your hubby is still working for the same employer, can't you just get an employment letter on (the same) company letterhead and send that, that's all their asking for right?

On another note, has anyone sent back their RFE and waiting for some sort of notification that the USCIS got it. They got my reply back on Monday 24th April and the online status hasn't changed.

The employer is different though, since he changed his contracting company. Even though he works for a certain company, he doesn't get paid directly by them. It all goes through different contracting companies, depending on what position you have got. So, on our I-864, we only wrote down the name of the contracting company, since they are the actual employer.

As for the online status, it isn't reliable, so don't go by that. If you received a notification that they got your RFE back, you are fine. You said you got one on Monday, right?

Oh I get what you mean, I wouldn't think you'd have to fill out an entire new I-864 just due to him changing his employer, but don't quote me on that.

Yeah I know they got the package, but it wasn't the USCIS that informed me. I had a signature confirmation through the USPS. I really want something from the USCIS to tell me they've got it, kinda worried.

Oh I see. If you look at Payala's timeline, she apparently received a notice a month later. So don't worry. But if you do, in my email it says you can call the service center during business hours if you have questions on your RFE. Maybe you can try and call them to find out?

My online status did change, I don't know exacly when they got the info , my father in law mailed it certified for me. My RD for this info is over a month after we mailed the requested info!!! I wouldn't expect any changes any time soon. I never received the actual letter saying they received it though :confused:
that kinda worries me.
 
Yeah at first I wrote in my post that the RD was few days after they received my info and then I looked at my own timeline!! A month!! WOW. I forgot I had to wait that long.
 
wow, never thought id have to wait a month..but thanks for the heads up. At least I can feel abit calmer now.
 
I just got the RFE. The request is very unexpected:
G: Submit a copy of the applicant's birth certificate. [...]
I'm a little confused, but it makes sense: I sent a certificate, which is as official and has the same information, but it is not titled "birth certificate". It's called "certificate of descent". It's the same thing though. Hm.

It's the only thing they requested.
Now I'm not sure what to do, I'll call the number I guess. Or ask my parents if they can get something that actually says: birth certificate. :rolleyes:
