RFE received for Jan2 2003 case. Please help...

The RFE came in today at the attorney office. It is to verify the current position and salary with the company. What kind of document should be prepared for this? Please help. Thanks a lot.

Hi,

U need a EVL which lists your hire date and the duties. The letter should indicate that they intend to hire u on a permanent basis and promise to pay u a salary which is = your salary mentioned in the labor application.I guess your attoney will have a standard format. Else visit the FAQ section under vermont centre on this forum and they have sample letters.

Did you change the company or address? or your salary at the time of labor was much less than DOL required salary?

Did not change company. Home address is changed. Not sure about the salary meeting the requirement. How should I find out?

LUD is Last Update Date. You can go to USCIS to set up an account to view and have email notification set up as well.
 
If your salary was less than the salary mentioned in the labor then you know that USCIS wants to know if the employer will be paying you the salary mentioned in the labor cert. many time due to increaments over the years and promotions will make your salary equal to or more than labor cert salary. hope this help s you xingfucun.

It is EB3 case. The RFE response is sent out this week and LUD is changed for RFE received. The RFE asks for the employment verification. The reason is that they said there is no indication of "permanent" employee status in the application (don't know why). Also the H1 is extended once, they want to know if the company is still supporting the application.

The package sent out includes a letter signed by the company and two recent pay stub.
