RFE received by INS Jun 20. Still Waiting! Any body in the same situation?

Hello Everybody,
     I replied to an RFE and it was received by INS on June 20. Since then
I have been waiting in frustration. Yesterday I finally ran out of patience and called up an iio. He said "The Case is under Review with
an Officer". The RFE was for
      1.) Company Name Change
      2.) Employment Letter ( Continued interest to hire )
      3.) 3 Months Pay Stubs.
      4.) W-2 Tax Returns for 2 years including all schedules.
      5.) All Non-Immigrant status changes, extensions etc.

     My ND: June 22, 2000
     My PD: Dec 07, 1998.
  
    It SEEMS LIKE SOME LAZY OFFICER IS LIKE REALLY SITTING ON MY CASE
    DOING NOTHING. Is any body else suffering from a similar situation?

looks like you are on the same boat as mine. My dates are as follows : EB3 - VSC

Prority Date - 09/28/1998
Receipt Date - 10/04/1999
Notification Date - 10/13/1999
FP Date - 03/08/2001
RFE Issued by INS for Employment Letter - 06/13/2001
RFE Recieved by INS - 07/02/2001
The AVM Says that the RFE was recieved on July 2nd and it is taking around 360 - 540 days to process this kind of a case. However since the initial processing was complete even before an RFE was issued it is taking approximately 540 days to process this kind of a case. It has already been 660 days since the reciept date of my I-485 application. I spoke to an IIO and she said just ignore the AVM as it is not right. She said the case is with an IIO under review and you will hear of a decision pretty soon.

I got RFE by May 10th, reply recd by May 30th

      1.) Photos
      2.) Employment Letter ( Continued interest to hire )

AVM still says on may 10th we sent you clarification....

Called IIOs, confirmed the RFE receipt by may 30th, and said
your case is "still pending under review" just 3 days before.

I am even checking the AVMs nowadays, rarely visit this site too.

My RFE was received by the INS on June 20th too and got approved on July, 17th. I think your approval is just around the corner. It probably might be in the mail today !!!

Incidentally, I had been checking that stupid AVM message and was surprised to find the Approval letters in the mail, when the message was still spouting the same old "On June, 20th 2001 we received your response to our request for additional....". Yesterday, we got our passports stamped and the message still has not changed.

Too Much delay after RFE

My RFE was sent by INS on May 10th, May 24th we replied, May 30th they received. AVM is not updated and still says RFE sent. I talked to IIO on June 12th, she said it will take another 30 days to wait. On Jun 25th, when I asked IIO, she said it will take 30 to 45 days further, did not like to give me more info. I tried to get as much info as possible, she was cool but not ready to give single bit of info, but a mere laugh and sarcasm at tone. My paralegal asked IIO on july 23rd, and informed me "still pending under review" status. I really do not know when it was assigned (whether it is assigned or not too). I have some critical situation like yours awaiting approval. Basically, I am fed up and do not have any choice to push up. thanks.
 
what are your dates ?

Can you please specify your category and case details. By the way what was the RFE for ?

They should clear all RFE\'s soon.An average time to clear RFE is 5 weeks, but there are cases approved with with in a week also.

RFE requested for the following info:-

AVM still says on RFE for more info received on 7/20/01....

What does still pending under review means? That is my status
 
This is what I think it means.

I think it just means some lazy iio is still going over your
set of documents and has not yet reached any kind of decision.
This kind of status is the most tension filled as one would have
waited so long ( about 3 years ) to get to a point where an iio
touches our case and then he issues an RFE asking for multiple
documents and we prepare them very quickly , fedex it the next day or
within 2 days and then we wait and wait and wait with anxiety!!!
That is what "Still Pending under review" amounts to. By the way,
my status is also the same as yours.

My wife\'s documents were received on July 12th 2001.
I guess my lawyer send mine also in the same packet.
But neither the AVM or the IIO says that they have recieved my response.
When i spoke to the IIO, she recited what i hear on the AVM.
She wasn\'t able to confirm that my resonse has been attached to my file or is in the mailroom.
My case is not yet even assigned to a officer. So i guess "Pending under review" is a much better status ...
I know that approval after sending the RFE is taking longer than ever.
This is just another ploy to get us feel frustated.
Folks ...
Just let us know when either of us gets some good news.(or atleast any discussion with an IIO)

I was little worried when they asked for photos. It means, I guess, they lost some of my documents, or whole. Hence, I feel that he/she started looking at my file a fresh.

   At last the AVM changed yesterday to say "Your Case has been
Approved as of July 31, 2001". Looks like that lazy iio has at
last decided to wake up. Your approvals should be coming very
shortly.
