RFE Question

How much time to do we have to respond to an RFE?
Who gets the RFE, my attorney? or is it mailed directly to me?

My wife's EAD is apporved, but they issued an RFE on mine on Nov 13, 2003 (she is the primary applicant). And we will be out of country till Dec 7th. I am just worried if i'll have enough time to respond to RFE after I come back.

Dinnu, who filed your EAD ? you or your attorney ? If your attorney did , he/she shd receive the RFE. On my 1st AP, there was a RFE which my attorney rec'd and immediately replied.
As per no of days to reply, some guys who got 485 RFE said they had 90 days to reply. Not sure abt EAD RFE?
 
If he filed on his own he will receive the RFE. You have to give the reply.

You are make sure the photograph taken is clear or you have to attach your wifes I140 copy... Thats all.

Well, our attorney filed it. But the problem is my wifed changed jobs after the EAD was filed. And the attorney is an employee of the previous company. We just got a response from her saying that she will forward the RFE to us and we will have to respond to it.

So i guess all i need to know is if i'll have enough time after we come back to respond to the RFE.

And btw, we don't have a copy of the I-140 approval notice as my wife's previous company has refused to give us a copy ( so that they can give us a tough time i guess). We didn't even know the SRC number of I-140 untill a couple of weeks ago. But my local congressman was able to find the SRC number from BCIS.

So all we have right now is a nice color print out of the online case status page for I-140 approval :D

I hope they don't ask for I-140 approval notice.

Sorry to hear about the Rfe. What documents did you enclose while submitting the EAD.?
