RFE question - salary

I received RFE requesting employment letter with info regarding detailed duties and my current salary etc. My current salary is about $15000 lower than that stipulated in Labor Certificate. My employer just agreed to put my current salary on the employment letter, will this be a problem and might get me denied because of this?

Please fill us in with some details, as it may have a bearing on your vase.

Are you with the same employer that sponsored your LC? If so, why is your current salary lower?

If not, did you switch jobs under AC21, and if so, will your new salary fit the prevailing wage for the job classification?

Hi sadiq

I was outsourced to a different company after 180 days I485 pending. So I qualify AC21. Job duties not changed, but business was not good, so my salary kept around $58500 while Labor certificate says $74000. But my current salary does fit the prevailing wage for the job classification.

Any advice or suggestions on how to phrase this situation in my reply for employment letter will be really appreciated.
 
Ok, this helps a bit. There are 3 items that I belive you need to make sure are covered in your RFE:

1. Standard reply indicating your company, job title, and wages. I had a standard employment RFE. Since I was doing the same job with the same company (higher salary than LC) it was a slam-dunk, but I am attaching a copy of the letter with the names changed.
2. Invoke AC-21 and explain why your current position is the same/similar as the one in your LC
3. Explain that your current compensation meets or exceeds the prevailing wage.

I’d like to mention that there are considerable details in your case. Get as much information as you can regarding the 3 items I pointed out and discuss them with an immigration lawyer. If your company has had experience in this matter, you may find that your Human Resources or Legal departments can also advise you .
