I applied for my wife's H1 this year. She left to India on Mar 15th. There is an RFE requesting my H1 documents and march 07 paystub.
however, I did not move from L1 to H1 till May 3rd. I have the pay of March given by my L1 employer. I started getting paystubs from my H1 employer since may 07.
Are we really in a mess now?
I consulted an attorney, she said me not to send any documents as she is in India and ask USCIS to work on the case with consular processing. However if USCIS gets back with the RFE again, then to send the L1 paystubs along with H1 paystubs.
