RFE on Speeding Ticket

I submitted my P3 a few weeks ago, and have received an RFE for a speeding ticket I received about 10 years ago. It was just a traffic violation--I wasn't charged with anything, etc. Now, the NVC wants court records, but I never went to court. I just paid the fine. Has anyone had a similar experience? HELP!! I don't know what to do....

Did you mention anything about this speeding ticket anywhere in your papers that you filed? If not, I guess NVC is doing a good job in the background.

Do you have proof that you had paid the fine and that you were cleared off the charges?
 
we dont have to mention speeding tickets anwhere, when filling GC.

I did not find it when i filled out my Gc application. If this is no correct then i am in a mess :eek:
 
Speeding Ticket

On Part II of form DS-230, one of the questions is you have been charged with any offense or crime. Technically a speeding ticket is an offense, so I put it down. My attorney didn't get hung up on it, so we filed it as is.

My quandry is that they want court records and I never went to court for it. Since it happened so long ago, the only thing I have is my driver's record showing the ticket on it. However, I sent a copy of it with the P3 and they seemed to have disregarded the whole thing.

Do you think I have to swear an affadavit or something? I'm really at a loss here, and my attorney hasn't suggested anything yet. Very frustrating!
 
It would have been good had you not mentioned the ticket as personally,I believe,you were charged for an offense but you settled it by paying the fine.
And so, it can no longer be deemed to be an offense or a crime. Had you been arrested and formally charged in a court, then it would have been an offense or a crime.

Probably, NVC thinks that you have not settled it either by attending the court or paying off the fine and that you have evaded the law.

Your attorney seems to be a lousy one as he should have taken care of this when you filled the DS 230.

Perhaps, your only chance now is to explain that you have paid off the fine and ALSO obtain a certificate from the police station that there is no criminal record against you. Also, obtain a copy of the proof of the payment and if possible, a letter from the court where you had paid this fine, that all is clear.

I cant think of anything else that you could possibly do to rectify the situation.
 
You would have gone to the court to pay off the fine even though you did not attend any hearing in front of a judge and the police officer.

So, the court will have a record of the payment that you have made.

I am sure you can solve the problem as I suggested above:

1. explain clearly the whole issue in a letter.

2. obtain a Police Clearance Letter

3. obtain a clearance letter from the court : I am not sure if any such thing exists,but you can speak to someone at the court and request them to issue you a clearance letter because of this problem that you have.


As soon as NVC saw that you have marked about that offense thing, they will not look or do anything else and simply issue an RFE rightaway. You could have expected it.It would have come anyway.

You can also try speaking to NVC and explain the problem and see what they suggest that you do.I am sure they would know how to deal with this and what they need from you to clear off this issue.
 
Part II of DS-230??

I thought you fill up DS 230 Part II when you go for the interview at the consulate. I did not fill up Part II while sending the docs to NVC. It is very strange to think you have filled up Part II in submitting to NVC.

Am I hallucinating or I missed something in my process. I just sent my P3 to NVC. Please clarify.

Regarding your situation, I think you could have expected this as you showed the way. I think you have interpreted the offence in a very broad way, of course I was never in such a situation myself.

We have to send only DS-230 Part1 with the Packet 3 to NVC and submit Part2 at the consulate at the time of the interview.

I overlooked this fact earlier and Krishna is right. Why did you have to fill out Part 2 now?

Anyway, I do not think this RFE is a very major issue and can be solved, except that you lose valuable time in this process and more headaches.
