RFE on I485, No update on I-140

Hi guys:

Just now I received the mail from USCIS regarding RFE on my I485:

On November 10, 2004, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283.

There is no update on I-140 or my wife's I-485.

Since our birth certificates did not contain our names and they were in Hindi and Marathi, we submitted affidavit's from our parents and the notarized english translations.

Could this be the reason for RFE. Can someone suggest as to what are the general RFE for I-485.

I-131(myself & spouse): RD 10/09/2003; ND 10/15/2003;App:12/01/2003 and 12/08/2003

I feel, it's a good sign for you. Your Attorney may be received your I140 approval already.

In many cases, NSC is not updating the status. It's random.

Answering I485 RFE is very easy as long as you're in status with right documents.

140 is the key for the entire GC processes.

my labour was RIR and I140 was files under section "Skilled Worker or Professional". I am not sure if this is EB2 or EB3.

Regarding my status, I don't think there is any problem. Finished my MS in US in Aug 2001, worked on OPT till August 2002 and received H1-B (before expiration of OPT) in August 2002, Filed labor in feb 2003, labor approved in August 2003 and filed 1-140 etc in October 2003. Both me and my wife are still in H1-B status. No change in employer.
 
it could very well be your birth certificate at times it is also medical , they need clarifications and or employment verification.
 
Rceived the amil today

I received the mail today sometime after 10 am, but the message says "On November 10, 2004,....."
When I checked the status, the last update shows 11/11/04. So, This suggests that the mail was sent today only.
 
I-485 Rfe

Hi all:

My HR department asked me to provide them with the copy of I-94 for the last entry in US. I don't know if USCIS asked anything else as I am not allowed to contact immigration attorney dierctly. I am trying to get the copy of RFE from my HR department.

Since I was asked to provide only the above information, I believe if there is anything else in the RFE, it must be related to the information from employer.

Can anyone please provide the estimate about the time USCIS takes to approve (hopefully) the application after the response to RFE is submitted.

I was issued an RFE for Letter of Employment. Should be straightforward.
I was approved within 1 week of responding.

Oct '03 Concurrent 140/485 filer.
RFE issued Oct 16, '04
RFE response Nov 15, '04
Approved 140/485 on Nov 24, '04
