Hi
I was wondering whether anyone of you have had RFE's on employment letter at the I-140/I-485 stage of the GC. If you could answer me the below questions that would be very helpful to me.

1) Basically I have lost my original of my 3rd last company that I worked for 4 yrs ago. however i do have the copy of it. The company as well is no longer there since it has filed for bankruptcy. I was wondering whether submitting the copy of employment letter for I-140 would be a CAUSE FOR RFE.
2) what kind of EMPLOYMENT LETTER RFE have you guys faced earlier and what kind of evidence did you furnish to convince INS on the RFE?

My RFE was for company financials. RFE sometime in April replied June 22 and approved June 25.

Please which type of company financial documents did you send?

Documents sent:

I believe the documents sent were 12 months bank statements, company tax returns, YTD Profit and Loss.

My attorney filed the original experience letters while filing the I-140/485 petition. Not sure whether its required to file the original letters.

--- You can submit copy of exp letter original is not submitted copy is enough. If you need new exp letter from the past exp as your company is closed you can also get a letter from any employee of past company he/she should state that you worked with that company and he/she was also employed at that time that letter should also have your friend (employee of past company) address on letter and contact phone #or he/she can type it on the current company letterhead where he/ she is working now.
2) What kind of EMPLOYMENT LETTER RFE have you guys faced earlier and what kind of evidence did you furnish to convince INS on the RFE?
--- Not having the Job title, Skills in detail or salary on exp past letters (salary is not must)
--- Education evaluation should be provided and it should match minimum what is asked on LC
--- Employer financial documents should be submitted or they send RFE, year company established, Employer federal Identification #, number of employees, gross annual income for last fiscal year, nature of business, what company do, provide audited financial statements or corporate income tax return from the time LC was filed to present
Employee also should send most recent W2, most recent pay stubs to avoid any RFE for these documents later.
Good lawyer prepares and sends all the documents needed and they know what BCIS is asking at this time.

Original Experience letters are not filed with I-140, copy of experience letters, copy of degree certificates/ transcripts, copy of Educational evaluation is submitted. Ask your lawyer he may have asked you for originals and may have attached copy of EXP certificates. If your attorney has sent original then you lawyer has to request to BCIS to send back the original after verifications

Hi Ginnu,

I really appreciate your active participation in the forum and it is really kind of u to share your knowledge in answering questions.

A small suggestion though...(I know its just me)...
but.. can you please differentiate the question you are replying with the answer...it happened to me many times that i feel you are asking the questions and usually it all becomes so jumbled up only the person who asked the question will understand it.

AGAIN...its me..may be I have some vision disabilty that i am feeling so but...please bold the question or something u know what I mean...

No offence meant buddy...

------- You are correct, who asked the question can understand, I try to post the ANS below the particular question it is meant for particular poster but others can read the info if it is related to them.
