RFE on EA please help, tansfer from EA to NIW

dear all,

I got an RFE on Oct. 19 on I-140 EA, however since my NIW was approved in Feb. 2008, lawyer suggested to ask for a transfer of I-485 from EA to NIW. Respond sent on Oct. 21, this Dec. 23, 2008 will be two months and still have not heard back from USCIS regarding transfer.
Anyone has similar situation? please share your experience, I am getting so nervous because of this transition, any advice please!

They tend to ignore the transfer requests. Just keep sending it once a week. Is a EB2 visa number available for you?
 
I do not understand, does this mean that I must file another i-485? or I should wait for the transfer? Please explain what you mean by "keep sending it once a week" , my lawyer says that by the book we can NOT request before 60 days! Also, the visa is current for my national under the EB2, any more advice please,

EA/EB-1 got approved :)

My EA/E-B1 got approved on Dec. 17, 08!
On the RFE, we asked for a transfer of I-485 to the approved NIW in the RFE, however in their second review of the file they approved it :)
and now I have to wait for the I-485, does anyone know how long it will take for uscis to get on it?
biometrics were done on June 6, 08, I-485 receipt notice is for Sept. 10, 07,
filing date is August 15, 07.
