RFE on Birth and parentage

Both I and my wife got an RFE that goes something like this:

"The documentation submitted is not sufficient to warrant favorable consideration of your petition/application ...

1. Please submit the oldest available evidence which establishes your birth and parentage. This evidence may include but is not limited to:

a. Hospital birth records which name the child and both parents.
b. Medical records which name the child and both parents.
c. School records which name the child and both parents.
d. Census records which name the child and both parents.
e. Religious records ...."

I am not entirely sure why we received this RFE since we submitted birth certificates with the I485. My thinking is that the birth certificate was handwritten (scrawled is more like it) and obtained recently, hence the RFE. But I am not sure.

Interestingly, my priority date is far from being current (India EB2 Aug 2005).

Both I and my spouse don't seem to have any records that list both parents. School records (Indian 10th std. marksheet) list date of birth and at most father's name. I am think of supplementing these with an affidavit from parents.

Does anyone else have experience with this kind of RFE? Is this a "routine" RFE or something I should be worried about?

Hi srini77,

YOu get the affidavit from two of your close relatives. If you had born before 1970s (I think) you can submit "record not available" obtained from competent authority with two affidavits from your uncle and aunt. this might work. you can submit your grade sheet where your date of birth is written as a secondary evidence. In some of the state in India I know of where both parents name are written in Secondary School Leaving Certificate book. another place where your parents can be there is your passport. In your passport you have DOB, place of birth and your parents name (can act as a secondary evidence).

In my case, I did submit birth certificate, so I cannot say record not available (also I am born after '70). 10th std. marksheet I am planning to submit. I do have school leaving certificate, but the info is same as in marksheet. Also, the passport pages is a good idea. I somehow had the impression we did submit those pages as well, as part of the initial evidence.

so right now I am planning to submit the following:
--10th std. marksheet and/or school leaving certificateshowing DoB
--affidavits from parents (do you suggest other relatives?)
--passport pages

please suggest if you can think of anything else that may be pertinent.

Birth Certificate issue

I am planning to file my I485 with 2 affidavits and 10th/12th mark sheets. When did you file your I485 and how long did it take for them to issue this RFE? I am trying to get NAC as well.

Card production ordered after RFE response

Just to update those who may face same situation, I sent the following:

--10th std. marksheet, school leaving certificate showing DoB
--affidavits from parents
--passport biographic pages
--driver license (India)

I see "card production ordered" as the current status, so I am assuming the case is approved. So the above evidence ought to work.
