RFE on AP

Hi Gurus,

I need your advice on this. I just received an RFE on my efiled AP application submitted along with my EAD renewal. They have requested for proof of an approved I-140. This is the my 4th year of EAD/AP renewal and this is the first time ever I got such an RFE. Maybe bcoz my 485 recently got moved from VSC to TSC. I did file the AP to the TSC.

Anyway my I-140 has been approved almost 3 years ago and I've changed my employer since then. My old employer's attorney once told me that they can't give me I140 approval notice since company was the beneficiary of I-140. I do have a copy of the I-485 receipt (still pending). Can you please advice on what I can do?

For AP eligibility, the only required evidence is 485 recipt notice. I hope you might have sent aleady with AP application. If they ask 140 approval notice, it is your burden to get it from old employer. If not, send a letter to them that why you can not get it, as it is the propery of old employer and they are declining your request. And ask USCIS to verify in their system, the approval 140 on behalf of you, by your A number.

I think you need copy of many things already there in the system like I-94, I-485 and also a copy of I-140 upon which all those applications built. If you have a copy of this just send it to them, they do not care at that time who is the beneficiary.
