RFE on AP case -> justify trip - Huh?

I received an RFE for my AP case at VSC.

AP (2nd)
RD: 8/21/2003
ND: 8/29/2003
RFE: 10/24/2003

The RFE requests:

"Please submit evidence in order to establish the granting of Advance Parole. A complete description of the emergent personal or bona fide business reasons of why parole should be
authorized must be stated. Your statement may include copys of any evidence you wish to be considered."

My lawyer says we need to justify the trip - ie personal reasons - going home for Christmas etc.

Does anyone know what this is really asking for? Has anyone seen this RFE before?

Did you not send the "support letter"? Yeah you need to plead (even if it is christmas) to get AP. see I485 FAQ for Ap support letter model.

That is a lot like the letter we came up with. Thankyou.

My lawyer found a memo from the INS dated August 15, 1997 that states (from AILA):

"Field offices shall approve an application for Advance Parole for any alien that has propery filed ... and who is seeking to depart temporarily for

any legitimate business or personal reason"

It then goes on and asks the adjudicating officer to not make any more inquriy into the reasons except if they suspect illegal activity!

Perhaps I got a trainee...

OH BOY!

Are we absolutely supposed to send this support letter? My office HR representative did not want to send it. I already sent the AP application. I guess I am getting an RFE then. Anyone who has NOT sent this letter and got approved without RFE, please respond! I can start preparing or even take preemptive action.
