RFE on 485: Birth Certificate

Hi,

I recenlty got RFE on my 485 for Birth Certitificate.

I got my birth certificate recently from india.
Birth certificate has my name in the following format just as in my passport.

e.g. [last name] [middle name] [first name].
All these 3 words in one line on my birth certificate.

In passport i have
For surname: [last name]
For Given name: [middle name] [first name]

But on all my Immigration & 485 application i have
[First name] [Last Name] but no middle name.

I only mentioned my name as [middle name] [first name] in the other names section in my 485 application.

Is this good or should i submit any affidavit or self affidavit explaining the above scenario of not mentioning middle name. Appreciate your valuable feedback.

What is the relation between that and his question. RFE could be issued even without current date, the file is not in dormant state as many think. For the OP explain the situation in very detailed letter with redundancy.

You have a couple of options here.
1. As you might be aware, getting another birth certificate from India, is quite easy. This time, just have them mention your first name and last name.

2. Write up an affidavit, approach an Indian consulate with your passport and get the affidavit signed. They will also write in one of the blank pages of the passport about the different names that you bear.

Do either one of these (or both), write a clear, concise and to the point letter, and send it in as the response to the RFE.

Trust me, it works. Although I did not get an RFE in this context, I have 3 middle names, and those three along with my Sur/Last name and my First/Given name were shuffled around in various combinations, by attorneys, uscis, etc. When ever I do my paperwork, I go through the hassle of including a letter with all the legal names ever used on my behalf. Just to keep the skies clear. In most forms, "alternative names" field is also helpful.

Dont worry, its a simple RFE, and once you provide the necessary docs, they will be satisfied.

Trying to understand what triggered the RFE. Is USCIS passively looking into pending 485s? If so in what order? by priority date?

I can think of other reasons too , like a job change, his AC21 or change in 140 (revoke) by ex employer.

Yes, USCIS frequently look for pending I485s without any reason, send RFE for FP every now and then (~1.5 years), ask about jobs even without changing address or jobs, deny many unqualified applications even without current day and so on. Some think if there is no current PD that they are safe and keep renewing the EAD, AP and be in peace till the day is current. This is not the case.
 
What was the reason they gave for requesting the birth certificate?
Did they specifically say that it was because of the names?

I got an RFE last week for my birth certificate because mine was not a full one with my parents names on it.
