RFE on 140 for educational eval. and experience

Hi all,
First, I am really sorry that I am starting a new thread. I thought this is the best way to get everybody's attention. I got an RFE on 140 for educational evaluation and experience.

It tells that the evaluation of the beneficiary's education submitted by you is insufficient because the work experience of the beneficiary was taken into consideration when making the determination of equivalency.

Please give me any info if anybody got similar RFE. I am pretty sure my lawyer screwed up something.

You need to be more specific. Please give more details abt your case, like category (EB1/2/3), lab subs, Concurrent, your qualification and yrs of experience etc.

There are a number of educational evaluation institutes which evaluates your foreign degree with corresponding US degree. If you are sure that you / ur lawyer had chosen the right category then resubmit all your experience an educational certificates/diplomas/degrees along with the edu evaluation.

I've received the similiar RFE. I've a 3 year degree and five years of work experience. My labor was approved in EB2 category. My lawyer said he's getting RFE for all the cases
he filed so far. He just had a similiar RFE two weeks ago. Eventhough he had sent an Education Evaluation, BCIS has
asked it again. I'll know more from him in couple of days and will
let you know more. If you find anything, please do the same.
Besides Education Evaluation, they want my companies TAX return and ability to pay evidence. As per my lawyer, it's a standard RFE so do not worry too much about it. But let's share as much info. as possible. If someone has gone through similiar exp., please guide/advise us.

I think it depends on your LC requirements (Column 14). Also, note that BCIS will not accept (in most cases, if you not lucky enough) the combination of degree/certificate to equate to a 4 year US BS.

I recently got a I-140 EB3 denial due to education equivalency and the denial letter clearly stated that experience and combination of degree/certificate will not be accepted.

I saw an article on this exact issue in murthy.com saying it is perfectly alright to have 3 year degree with additional training is equivalent of 4 year degree.The director or some senior guy issued directive to the field guys saying that is perfectly alrght .You can get more info on this in Mrssheela murthy web site .

Where are you? You started this thread and disappeared! My
lawyer has asked me to get experience letters and Company Financial while he works towards getting Education Evaluation
done again.

Hi all,
First, my case details. My case was filed under EB3/RIR. It is not a labor substitution. I have more than 5 years of experience with a 4 year degree in Mech. Eng.
I talked with my lawyer and according to her whoever raised this RFE was confused. My lawyer sent the Bachelor's degree and also sent a Masters equivalency (based upon my 5 years of experience). So, the person at BCIS is confused about the masters equivalency. My lawyer is going to resent the educational evaluation for my bachelors degree with the experience certificates from previous lawyers.
I will let you guys know if I hear anything else from my lawyer.
