RFE mailed on 8/27

Pursuant to my request for expediting, INS has mailed out an RFE.
My petition is employment based (Religious EB 4).

Interestingly, my wife, whose I-485 is based on my application has not been issued an RFE.

Does anyone know what I can expect?

How common is this?

Is this good news?

Thanks.

Without knowing what the RFE is about, can't say much.

It is possible for you to get an RFE, and not your wife...depends on what the RFE is about. Answering your RFE might satisfy a condition for the derivative applicant as well.

This is good or bad news depending on whether you can or cannot respond satisfactorily to the RFE AND whether, therefore, BCIS can adjudicate your case, by the sunset deadline.

Unless I'm mistaken, the sunset deadline is for adjudication, and not timely submission of I-485 or response to RFE. Check the actual wording, please.

If indeed there is a deadline problem looming, while responding to your RFE, include a plea for favorable consideration in light of your timely filing, the long processing times, and additional time being spent to respond to RFE.

Employment Verification Letter. Apparently mandatory if application pending for more than a year. I understand religious worker is still employment based?

Just a thought...
When replying to the RFE, Fedex, not mail, your envelope.
On the inner envelope, write "RFE Response for Religious Worker. Sunset deadline EXPEDITE processing"

I'm borrowing this concept from what used to be done for children age-out cases. Can't hurt. Or, your RFE might even come with instructions for special expedite labeling.

Hope its only your EVL they want. At least keep that and a cover letter ready. I want to be able to post you a congratulatory message before 9/30 is out.

You're religious, aren't you? After helping yourself, just leave it to a higher power... and I jest not.

Thank you for your responses.

Yes, the Religious Worker category is Employment based. I believe it's EB 4.

Employment verification letter is not a problem.

Are they also looking for financial documents i.e. W-2, paystubs?
Will photo copies be sufficient?

Thanks for the FED-Ex suggestion.

RFE

What is the format for the Employment Verification Letter?

Does anyone know what specific wording and info. should be included?

Thanks.

Note that Fedex does not deliver to P.O.Box.. If the RFE response specifies a specific address (no P.O.Box) you are fine..otherwise use Express Mail/others...

My attorney uses Airborne Express... so, ysolong, if you remind me Tuesday, Sep 2, I can check regarding the P O Box thing.

Good point, wonderful!

ysolong,

I checked with my attorney's office. They use Fedex too. RFE response address will likely not have a PO Box.

wonderfull's point still holds. In case they give you a PO Box, depending on your level of desperation, you could travel to the zipcode indicated, and hand your stamped envelope over across the counter to the USPS office serving that zipcode.

ADDED LATER:

Address for RFE response in a friend's recent EAD RFE case:

CAlifornia Service Center
24000 Avila Rd
2nd floor, Room 2302
LAguna Niguel, CA 92677
