RFE - Lost job after 180 days

Cheerful

New Member
I applied my 485 at Vermont Service center. My RD is Aug 1, 2001. I have EAD. I crossed 180 days and then I was laid off. It was 3 months back. The company would not co-operate in any manner. I got hold of a new lawyer....filed new G-28. Now I am expecting an RFE any time as my company informed INS that I no longer work for them. I am looking for a job but could not find one. I am trying my best. If I dont get a job and cann\'t respond to RFE, will my GC application be canceled? Can anybody help me with any suggestion? I would be indebted as I am in a bad situation with my wife.....please help

Dont Worry

Do not loose heart and try to take up any opening you get even if your salary is far lower than what you received till you get your gc.

I understand that saying it is easy but keep trying.

Find another company.

I am not a lawyer, and this is not legal, try on your own risk.

Try to find some small company. They will take your money (cash, no record) and pay you in the form of pay stub. You might have to pay taxes on it. In this way, legally you will be in job. In case if you get RFE, then you have proof of your pay stubs that you are in job. There are so many small companies who does this. Best of luck for this.

The amount of the pay stub....

I know the amount of the pay stubs should be over the amount stated on your application of Labor Certification. If this is wrong information, please advice me.

can you give some names of those companies? are those langauti

software sweat shops? i have heard of some chor desi lawyers in NY area taking money for restaurant cook GC applications ($12-14K) some of them are one person indian restaurants(that basically exists only in names).

chances of rfe

When did u do fp ? Before feb ? If you were getting an RFE, you should have already got it, since u have applied more than 10 months ago ?

You may not have problem for GC. here is an story of my friend:

he got layoff after 10 months and couldn\'t find a job until 1 month later. Then on the second month of his new employer, he got his GC approval.

I think the real problem for you is that your employer informed INS. While I hope same thing happen to you, I would suggest you talk this with your lawyer and find a legal solution.

Wait and See

I would suggest to wait until you get an RFE and keep trying for a job.

Most of the times one can get approval with out an RFE.
