Dear Friends,
I need some ideas from you guys. I have being asked to leave the company from OCT 18th . I got an RFE for the updated emp letter and i have sent it to my legal dept. The RFE says

"Submit a currently issued letter or other evidence from the prospective permanent employer that indicates your current position,if any,your proferred position,and proferred wage and indicating that the terms and conditions of the employment petition continue to exist."

My legal department says they can furnish everything expect they cannot mention that the "terms and conditions of the employment petition continue to exist." . This is because i will not be an employee anymore with the company after OCT 18th.

My question is will the emp letter without mentioning above statement is OK to submit ? . If I submit will my I-485 be denied. If not any ideas from you friends.

Find New Employment Immediately

You could send a letter without that stipulation and delay the action a bit until you find an employer who will sponsor you. Just keep in mind that you will receive a new RFE in the future asking for another employment letter. Hopefully, you will have a sponsor who will furnish all the stipulations you need in that letter. I'm assuming you have an EAD.

I got that solved guys. Was able to get the letter and sent it to INS.
My RD 07/30/2001
ND 09/10/2001
RFE 10/02/2002
RFE sent on 10/08/2002.
Waiting for approval.

Hello GCHORROR,

I appreciate if you could let me know, how did you manage to get the RFE letter to you, instead of the Attorney. I think you mentioned somewhere that you got the RFE mailed to you, not attorney. I am in a stage, where my lawyer may not give the RFE to me and I changed jobs after 180 days.

Hi! GCHorror...I would like to know that after speaking about resending your RFE with IIO in howmany days you received it? My RFE was generated on 27th Sept. I didn't get it so, I called today and IIO varified my address and said that I should get it in 7-10 days. Your input is greatly appriciated. Thank you...
 
Hi Sameer,
This is how it works in our company, that we get all the correspondence from INS and we send it to our legal department for further action. There is nothing I did to route any mails from INS to me.

My RFE was issued on sept 23rd and i didnt receive till OCT 1st and called up INS to check with them and since i had changed my address, I kind of asked them to resend it and they said they will do it only after 14 days is elapsed and they did on OCT 8th .
I think u can ask them to resend the RFE letter again .
 
Hi GCHORROR,

How many days did INS give you to respond with current employment information? If you call and ask to respond, do they
add new date of 'so many days' to that old (original letter) date?

Also please let me know from your experience, if the INS is looking
for the "current on the payroll job" or any "similar job OFFER"
that will be commencing very soon. Do they look for any discontinuity after 180 days job change and question on why one doesn't have work NOW but a month down the road he has a job? If you can please give some insights. You have better info/knowledge than many of us here.

The RFE response for my case was dec 16th and i think its around 2 1/2 months to respond. They didnt change this date when they resent the letter.

See my first message at the top and thats exactly they asked for .
They didnt ask anything apart from this.

As it reads below, it sounds like they want 'either present employment' or 'the future permanent employment', can we as layman assume that?
Lawyers may interpret it differently but what is your thought?
