Hello Guys,
My case status changed today to RFE issued. I am a bit disappointed, but I guess no point getting upset since it is out of my hands. I guess the best thing, while I wait for the notice, is to start working on common RFE stuff so I could save some time

Anyway, I am GUESSING that perhaps the RFE is for Birth Certificate. I did not have a Birth Certificate when I filed my 485 and hence got one from the Indian Embassy in New York only to find out that INS / BCIS does not accept a certificate issues by the Embassy. But it was too late by then, my application had long been submitted to the INS.

I searched the forum on this issue and found that we have to submit 2 affidavits and perhaps a non-availability certificate.

Can someone please provide a sample of the affidavits? I searched the forum and found one or two links, but I was hoping to find a sample from someone who had used it and it worked for them or perhaps was provided to them by an attorney.

Also, can I use my parents for one of the affidavits? I heard from a friend that you couldn’t use an affidavit given by your parents. Is that true?

Does it have to be on a stamp paper? Or just the regular paper will do?

affidavits from parents are acceptable. My lawyer asked me and I got it from my parents. If you do not get the format/sample affidavits by evening then I can provide one, I have it in my home computer.

RD2426 please provide your filing details if you are posting about your 485. Also pass me your email and I will send you the format for Affadavit.
 
Don't get affidavit from parents? This is a bit confusing, because I am getting mixed responses on this. One of my friend asked me to not get affidavit from parents as well. However WIN said affidavits from parents are acceptable and that he got one from his parents.

WIN, did INS / BCIS accept affidavit you got from your parents? Has your case been approved yet?

Also, please let me know if I have to get them on a stamp paper or just a regular paper?

And how about Non-availability Certificate, do I need to send them that too or do the records & registration guys (in India) already have the certificate (standard form) and they just have to write my name on it and issue it.

Guys, please throw some light on this.

If you are primary applicant, it is advisable not to submit affidavit from your parents. The reason that the lawyer gives is that your parents may have intentions that they get their GC after you get yours and hence maybe ready to sign anything.
Dont bash but that is how it works.
People may have got approved with affidavit from parents, but people have also got approved with BC from Indian Consulate ;)
My advice is dont take chances and get them from anybody in your family.
Also, as far as Non availibility certificate goes there is no fixed format and usually you will have to fix up something with the officials there to get it on paper.
Everything is required on Stamp paper. You can scan them/fax them to your lawyer to save time on your RFE reply.
