RFE issued (not yet received) on I485

Let me introduce myself. My name is Depressed Alien and I am very depressed. I filed I-485 concurrently with I-140 in April, 2006 (EB1 "Outstanding prof." - that's what I am). The I-140 was approved in May 2006. The I-485 is still pending. A response to my telephone inquiry regarding an apparent delay was that an investigation into my background remains open. Ok. I was flattered. I must be something if they are studying my background for a year. Anyway.

Last Friday my wife (derivative I485) and I (the man) received the following e-mail:

"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: We mailed you a notice requesting additional evidence.

On March 16, 2007, we mailed a notice requesting additional evidence and/or information in this case. Please follow the instructions on the notice to submit the evidence and/or information requested. This case will be held in suspense until we either receive the evidence or the opportunity to submit it expires. Once you submit the information and/or evidence requested, you will be notified by mail when a decision is made, or if the office needs something further from you. If you move while this case is pending, call customer service. "

My (multiple choice) questions for you, immigration gurus and alike, are

Q1 Is the RFE a good sign?

1. It is a good sign
2. It is a bad sign
3. Neutral

Q2 Is it normal?

1. Getting an RFE in your situation is normal
2. Getting an RFE in your situation is unusual


Today is March 21 and I still have not received it in the mail (NSC- > Wash.DC). What would be your advice:

Q3
1. Do not worry, it is too early
2. I would be worried, it should have been delivered by now

And finally if I do not receive it within say 10 days, what should I do

Q4
1. That's it. Shoot yourself.
2. Call customer service and ask for another one
3. Hire a lawer and let him pull the strings

Did you manage to get any information from USCIC (infopass, calling "customer service," or perhaps FBI) to get any reasonable information as to what this is all about and when it may end?

Do you think that your delay may be related to Technology Alert List?

Have you thought of filing a Mandamus lawsuit?

You advice to wait 30 days is reasnoble, but here is the scoop:

Based on what I've read here it appears that all RFEs require a response within a certain time-frame. If you do not respond, the case is denied as abandoned. If the underlying application is I485 and the applicant has used his AP or EAD he becomes out-of-status immediately and stricktly speaking must leave the country.

Is there anybody here, who is familiar with this scenario? Is there any way to protect oneself from this, e.g. by restoring a valid non-immigrant status? If you really know anything about it, please let me know. Thanks

You advice to wait 30 days is reasnoble, but here is the scoop:

This is not advice, this is what is written every where in the USCIS web site and this is the answer you will get even without accessing your data. Usually the time to respond is 60 days and many applications denied because of undelivered requests.
Based on what I've read here it appears that all RFEs require a response within a certain time-frame. If you do not respond, the case is denied as abandoned. Yes, you are right, what the people usually do is to request reopen of the case because they did not receive the notice. And to get non immigrant status by then you have to go outside the US to get it. You can not change status here from AOS to H or O for example.

You know, this is my second attempt to get a green card so I kind of get used to it. I quit waiting and just trying to live a life. I am getting a new job, moving to a different city. It is a stress but f. FBI and USCIS, I am doing it. You can stay depressed, feel lost, abused and in the beurocracy limbo, but it is not how you want to spend your best years. Especially if you have little control over it why be depressed? It's like being depressed cause you can't fly? Someone promised you wings and you are here on the ground, feeling miserable? Is there something in particular you can't do without GC? Are you upset because you can't vote?

To your question. I think it is because my background check is being done and the same check is done to my two other Russian friends and some other Russian people I know. I check this with USCIS on infopass and from their letters. Whatever. Let them check anything they want, I am not a criminal. I can work here doing what I like. I can do the same in my home country if I have to. I will be middle class anywhere in the world.

As you can probably see getting GC isn't really highest priority in my life. But I just got really upset with the incident when my friend's wife couldn't get a job because an imbecile in a security dept. said that she has FBI check pending and the company shouldn't hire her. It was a little bit of shock for me because of being in the middle of job change and BG checks are widely used these days. But it seems my perspective employer works with normal people, so I kind of made it past the check and feel better.

Technology Alert? What is it?

I can theoretically file Madamus but lawyer asks for 3.5K. I am not in such a rush.

I got you. You are an intrinsically happy person. Even is such a mess, you can live your life or at least pretend you are living.

I wish I were like you, but I am different. I want more, fast, and now. I am always unhappy. And now this GC thing is a really nice slow torture. A black box you know nothing about. Although, there is perhaps nothing intersting to know: A bunch of mediocrities who feel real power over us. Standard story.

We are trying to guess why we received this or that decision; why one case gets a fast approval, while another generates an RFE asking for your penis size. These are interesting questions, but the randomness and unreasonableness of all this suggest, that there is no logic behind it at all. May be it is just that in the former case we are dealing with an officer who was in a good mood, while in the latter we are dealing with a person, who is not entirely satisfied in various aspects of his or her life.

Oh, don't let exaggregated problems ruin your life. There will be always someone who stands in your way. Even if you are a president there will be bunch of jerks who will try to ruin the fun you could have had from the war in Iraq. :-) Deal with it as a grown up. Do your best and if you can't control it turn to God and let Him take care of the problems for you.
 
RFE May reach attorney

The RFE goes to attorney on record. So you will keep waiting for the mail and the mail may have reached attorney. Let us know what the RFE is about. I think you may get it today(5 business day)

The problem is that I did not use an attorney. I filed all documents myself.

I also used an "in care of" address of a close friend of mine, since I knew I would be moving. This address has worked Ok so far and if a letter were delivered I would have known about it immediately.

It however has not been delivered today March 22. According to their e-notice it was mailed on March 16 (Friday). So, I am worried.

Let's all get paranoid and guess: Is it possible that USCIS generates undeliverable RFEs to claim that no response has been received, thus it's abandoned and further denied?

Is there any way to officially (by certified mail/fax) inquire about the status of the RFE and request it resent to have a proof to support possible future motion to reopen case.

ONe of my transfer notice from NSC was sent on March 14, 2007 and I have not received yet. its been 8 days now. I will wait for another week and if nothing comes then i will call customer service.

I do not think you should start worrying as of now.
First it may take up to a week or so to receive the RFE. I think you should wait until the end of the week and if you receive nothing then call the Service Center on Monday.
Second: You can keep trying to guess what the RFE is about but unfortunatelly your only option is to wait to receive it and once you have it go from there....
Third: Shooting yourself in the interim is not going to change anything so why do it?

On the bright side: you do not get unpleasant surprises, only pleasant ones when the Murphy law "If anything can go wrong, it will" breaks down (do not confuse the Murphy law with the Murthy law group.)

Here is a good example of the Murphy law in action: I have not received the RFE. Eventhough it has been a week since they mailed it (according to their web-site).

My spouse transfer notice was mailed from NSC on March 14, 2007 and today I received the notice. Probably you will receive yours on Monday or tuesday. that is what I think considering your RFE was mailed on March 16 from NSC.

Thanks for letting me know. Do they also post transfer notices on the web and send electronic notifications by e-mail?

You know why I am so paranoid: Not only because I feel unwell, but also because I've had so much sh*t from INS/USCIS you can't imagine:

(1) Last time I aplpied for visa, I waited 6 months for security clearance, (2) My mother has been denied visa twice for no reason, (3) My first attempt to get a GC through Labor Certification died because for the first time in the University history the case was sent for audit which never ended, (4) In my (current) second attempt to get a GC through EB1 my I485 has been under some kind of security investigation for a year, now this RFE... I just can't expect anything good.

Also, when I first was coming to the US my plane almost crashed (decompression of the cabin, oxygen masks, emergency landing).

You know, I am thinkning: May be God is trying to tell me "Depressed Alien. This country is not for you. Get the hell out of there." What do you think?

D.A.........in short you have been screwed endlessly.........sorry to hear that dude.........same here.......trying to get a some control over life since 10 years.......but not successful yet..

regarding USCIS.......its pretty simple.......they dont care for immigrants anymore........their message is plain and simple........if you badly want to stay in usa.....put up with all this shit for a long time (4-5 years atleast) and you may get it..........else please go anywhere you want...

I like this country.....so i am waiting.....i am too not happy but i am not yet ready to relocate to another country.........too tired for that......

btw..my name check is pending since 6 months only.........and considering my luck........i am not expecting it before 24 months........i am going to wait another 6 months.......and then start doing followups with congressman etc..

my spouse got RFE for medical (TB skin test not done..)........luckily for us it only took 8 days to receive it though.

Have not recvd it yet and also the status still is the same. Pls let me know what ur situation is.
