RFE Issued, Company doesnot want to give Tax return

Dear Gurus,

Could you please respond to me regarding this issue?
I got RFE requesting petitioner to show:

Petitioner must demonstrate this ability at the time the priority date is established and continuing until the beneficiary obtains lawful permanent residence. Evidence of this ability shall be either in the form of copies of annual reports, federal tax returns or audited financial statements. Such evidence may also include pay stubs or other documentation indicating that petitioner has actually been paying the proffered wage.
The petitioner is requested to provide for the past three years.

My company has about 35 peoples. My employer doesn’t want to release any info regarding their tax return. They said they even do not provide this type of info to their lawyer. When I tried to convince him, finally they want to provide the payroll info. Is that pay roll info to respond these types of RFE enough?

About the employment verification letter, they will provide that to me.

Could you please suggest me about it. I will highly appreciate it.

I am not sure whether I have the answer. But a similar situation happened with my friend.

His employer was unwilling to give the tax return of the company and payroll report. his lawyer contact the CEO of the company and told him to send to him in a sealed envelope. The lawyer will not open the envelope, and will just forward the envelope. His employer did exactly that and his case was approved.

They probably didn't ignore, Mr.Laguna. They donot have an answer to your question(s). People in this forum, most of the times, are very helpful.

Sometimes questions just get buried under other threads, and other times people don't know the answer. I am sure you would rather get correct answers as compared to rumors and thread crappers posting in your thread.

It is also customary for the person posting the question to "Search" the archives for similar situations, which greatly cuts down on the bandwidth used and reduces the time lag in getting answered. So don't take the response time so seriously.
