RFE issued....and the long saga continues

My AVM says that on Feb 27 an RFE was issued. I don\'t know what this is about but am very dissapointed as I was waiting eagerly for my approval. Strangely though, my wifes AVM still says that famous "Jan 4 resumed message". I wonder why hers had not changed.

My case is slightly different as I donot work for the sponsoring comapny, but do intend to join them once my GC is approved. I did change my company after I got my EAD but before my 180 days were over. I talked to my lawyer and she said that that should be OK as I intend to work for the sponsoring employer only after my 485 was approved.

Do you guys think that I will be OK ?? Is there any pproblem with my case ??? Could this be the cause of an RFE??

Please suggest.....

your I-140 and 485 was applied by company \'A\'
did u supply employment letter and pay stubs and if so of which company - was pay stubs supplied of same company \'A\'

I worked for company A when Company B filed my GC (140 and 485) Company B is my sponsoring employer and I intend to join them after my 485 is approved. After I got my EAD but before 180 days from RD, I joined company C. The job and responsibilities are exactly the same.
I hope this makes sense now....please suggest

which immigration status did you use to work for company A? this info is important if you need some advice
 
What exactly is the employment letter that INS wants

Is it the offer letter that company B gave me when they offered me that job or is this a letter of intent that I have to provide to INS that they are still willing to hire me upon the approval of my GC ?

So do you still intend to work for Company B once you get your GC? Even if you intend to continue working for Co C. after getting the GC that should not be a problem.

If you really think about it, I think even the INS is confused about the whole GC process. The GC is actually supposed to be for situations such as yours, where you are applying for intended employment instead of the current employer. The question that arises then is why do they (INS) ask for pay stubs as reasons for RFE????? Are they implying that GC is for your current employer??? Since majority of GC cases have been for current employers, I guess even INS has forgotten why the GC process was created (hey another oxymoron "GC" and "process" ;-) I guess the old adage of "Majority Wins" holds true everywhere (i.e. screw the laws bcos it is too confusing to follow - v don\'t care if it was created for intended employment, now that everyone is applying for the current employer let\'s just go with that trend, strange how human beings are the same everywhere). Well, at this point who gives a s@#$. Sorry if I didn\'t answer your question, but you will find out soon enough anyway (about the reason for your RFE), and if you don\'t, send them a letter/fax/call/visit so they don\'t deny your application for lack of response. You never know (you never got it???? well that is not our fault!!!). I hope your RFE is for something minor and you get your approval very soon.

As an aside, if I\'m not mistaken, are Co A. and C. Consulting Companies and Co B. the end employer? - u don\'t have to answer that. Good luck - hope u get your freedom soon.

still intending to employ u when u get gc - will they give u such a letter again now and do u intend to join them when u get gc ?

If yes then why dont u join company B now

since u have ead - i am a little surprised why u r working for company c
 
Since Company B is aware of my situation

I hope they should be able to provide me with the letter. Also the reason I am not with comapny B right now is that they are not paying me as well as company C. But that does not mean that I don\'t want my GC approved soon bcos than I will have to join company B for lesser salary. I am ready to that once my GC is approved. And since comapny B also is not pressurising me to join them I did not see any reaon joining them before my GC approval. BTW the lawyer who is doing my GC is from company B and is aware of this situation (read mess). I joined company C only after consulting with them.

u r okay - when the rfe comes
u have to attend to it

I am sure that u will not have any problems because company b will give u all the documentation u need and this will satisfy INS

it is now a waiting game to wait for rfe notice.
This will not come to ur address but to the lawyer\'s address within 5-7 days

keep in touch with him by phone or email and request him to fax the notice to u and make sure that he attends to it so that this is not delayed.
 
Have you passed 180 days now?

Most REFs asked couple recent paystubs, current employer letter, maybe couple years tax returns. Do you have couple paystubs from company C? I guess you don\'t have any paystub from Company B. Will company C willing to supply the employer letter? Have you thought of using all documents from company C instead of company B since you passed 180 days? This is just my 2 cents. Hope this could give you one more option.

paystubs and employment letter from Company C will not be a problem. I can also get the letter from company B, if required. I hope this should suffice.....hoping and praying for quick approval.....
