RFE for Tax Returns: Do we have to sign tax returns?

My husband (primary applicant) has received RFE for W2, tax returns for 2002, emp. letter and 6 months paystubs. I have a few questions about it -

1) We have our copy of the tax return - but it's merely a photocopy and we have not signed it anywhere. Should we sign it and date it before sending it to BCIS?

2) Our taxes were filed by a CPA - he too has not signed the tax returns as it's a photocopy. Does he need to sign it ? (in the original tax return there are places where he signs)

3) Has anyone who's sent tax returns without signature been approved in the past?

4) The RFE asks for form W2 for my husband. We file our taxes jointly. Should my W2 also be sent with the RFE response?

After a long wait of 2 months, HR has given us an employment letter and RFE details... Hoping to send the reply soon.

Would really appreciate your opinions/experiences !

Tax returns -- are filed by YOU
So you can sign if you want. No harm , no waiting or thinking.

CPA signs for you that he prepared. No need of that stupid signature.

If you are Employed - you get W2 - that should be sent. Else Tax returns does not match the figures .

ALL ARE straight and stupid .. I mean simple questions.

YOu think a lot.. unnecessarily.
Just send what U have :D:D
 
First you need to do is, contact your cpa and get the signed copy. I am hoping he will have it. Otherwise IRS won't accept your application.
Think about it, if you can file with out signature, anyone can file your returns and you will be the sufferer.
Anyway the only way I see is contact your cpa immediately, he should be able to tell you whether he could give them to you or not, in a minute. If he says no, I think next best bet is call IRS asap. They should be able to help you. One of my friends got a print from IRS, when he needs to file an amendment to the already filed returns. . .
It is good to be fool proof rather than giving them the chance of generating one more rfe. . .
Check your time limit on responding to the rfe and don't miss the dead line. . .

Best is to obtain your tax return transcripts from IRS. Also, remember to obtain the transaction transcripts. This will prove that you did pay IRS or IRS did return any overpayments. You typically get the transcripts via mail in about a week.

If you get the transcripts directly from IRS you don't need this.

BCIS would typically ask for the W-2 only for the primary applicant. But I guess there's no harm in sending your W-2 too.

Our CPA is out of town on vacation till 08/12... I shall try the IRS site or visit our local IRS office - otherwise just wait till 08/12...
 
Went to the local IRS office

After reading your replies I went to the local IRA office - it's just 5 miles from my work. There I got the transcripts for our 2002 tax returns - which is good! But if I want to get a copy of our tax returns, I've to send a written/online request and it'll take 30-60 days!!!

Maybe we'll ask our lawyer tomorrow - she too has a day off today :confused:

Maybe I'm just having a bad day!
 
I don't see any harm in signing the photocopy that you have. All they care about is if you have filed your taxes or not. If you owed them money just send a photocopy of the cancelled check as a evidence that you paid your taxes. That is what I did. I also think your lawyer is a moron. You got this RFE in the 2nd week of June and he/she is giving you the details now. That is ridiculous.
 
You can sign the photocopy. BCIS won't investigate if the signature is originial. If they can ask a copy from IRS, then why they asked you to send to them. All they care is if you were out of status and if you earn the money on your LC. Don't worry
 
Your CPA would have electronically filed your tax papers. In that case there is no signature and you would have signed a voucher or some other one page form to file your returns. A photocopy without the signature should be enough in your case. Why do you want to wait any more time in sending the copies you have?
 
BCIS officers are not trained IRS officers, they don't pay attention to what's on your tax form, as long as it's consistent with W-2 and they can keep a copy in their folder. It's fine.
