RFE for re-entry permit

Applied on May 16 (myself and my wife). Both of us have RTD valid until Dec 2006.

Got an RFE yesterday: "you already have valid re-entry permits. Send those back or tell us what happened, or we will deny your application."

We dont have reentry permits, we have RTDs. But is it worth arguing the point? When I applied, I already made that clear that I have RTD and not sending it becuase I will be using it soon, and I did travel in June.

I might have to travel for work soon, so having the RTD on hand would be useful, but can I risk this with some idiot who does not understand the difference between and RTD and RP?

I am leaning towards sending the RTDs back. Comments?
 
It is the law of the land. If you have valid travel document (regardless of whether it is RTD or REP) you have to surrender it along with your application so that a new one can be issued to you.

My advice return the old one so that you can get a new one. The UCIS is sensative with documents because they can be used for multipable purposes. Even though you may have genuine interests that you may wanna use for your valid document; others abused it.

Hi,

You can send the RTD's back and write a letter explaining the reason why you kept and also why it should be returned to you. Usually by law if the unexpired RTD contains valid visas or any visa you can make a request for the service to return it. I had a valid RTD when I applied but mine was about 3 months to expiration and I never received any RFE asking for the previous one. It all depend s on the IO processing your case, each case is handled differently.
