Me and my husband both got 140 through different companies and ready to apply for 485 after long wait. I am pregnant and got TB test -ve, but did not get any shots, obviously. My physician gave the sealed envelope stating these facts. Now I'd like to apply for 485 as primary through my attorney as my company would pay for it.

1) If I get RFE for not taking shots, would that affect my husband's case? Is his case dependent on my case pending?
2) Would making my husband primary be the better option? If yes, what original documents he needs from his attorney? We want to go through my attorney.

1. You will not get any RFE for not taking shots as long as your physician mentiond that you are pregnant in your I-693 Remarks section.
and even if you get a RFE on your Medical Report( for unkown reasons ) it will no way affect your husbands (derivatives) application.

2.PDs might retrogress back in aug/sep, keeping this in mind, it is advisable to act based on your PDs, meaning who ever is having an earlier PD be the primary applicant.

Good Luck :)

Thank u IN2US..

My husbands priority date is one month earlier and will use that to apply.. Any way there are rumors that USCIS will not take EB-2/3 applications in July. If that's the case the only people laughing all the way to the bank would be the attorneys who don't need to file anything, but cash in $2-3k for everyone like me trying to beat the crowd.

Are the attorneys part of the scam?
