I got RFE for I-140 amendment in May 01 , lawyer replied promptly ,
I-140 approved may 29 , AVM updated Aug 1 , saying received the RFE response on Aug 1 ...., no approval yet , anybody in same boat ?
I have seen couple of friends of mine who got such an RFE and I have seen approvals come in anywhere from 2 to 4 months.....
Hang in there You will get your approval soon.
My case is also similar to you.. I replied in last week of Feb for I-140 (amended).
I140 Amendment : WAC-01-123-xxxx. My lawyer talked to IIO last month, he was
informed that my file is with an Officer.. I have not heard anything. I will keep you
posted on the developments. Please let me know if you hear something..
Is the amended/new 140 is approved in all the cases ? Because unless I140 is approved the case will not taken for approval. It is a different thing that my new I140 got approved in the 2nd week of August and still waiting for I485 approval.
I received an RFE for company name change on Feb 2001. My lawyer replied on 04/13/01. ND was on 04/16/01. Amended I140 was accepted on Aug 16th 2001. My I485 is still pending. It is really frustrating since I have no idea on how INS officers work. How the INS agent handling my I485 will findout that Amended I140 has been accepted. I recently called INS. They simply said that my case is still pending. They did not even know, from their computer screen, that my Amended I140 was accepted.
Any insight on how INS handles this type of cases would be very much appreciated!
My attorney told me that I-140 amends will take more time as the officer assigned has to get
the old I-140 file to check the original Labor Certification. Our Original Labor Certifications were
submitted with our first I-140. So what he says is it all depends on IIO who is handling our cases
who has to look through the old files and get the labor certification. So we are off the track and
it depends purely on IIO to have some interest and look into old files.
Along with the RFE reply your attorney might have sent
the receipt notice of I-140 amendment, he should contact INS when the I-140 is approved, and ask that they adjudicate
the I-485 petition, as the change in employers name was
the reason for the amended I-140.
Hope we get our approvals soon.
I am still waiting for my I-140 (amendment) with receipt date of
03/16/01 to get approved.
I-140 Approved in Aug 2000 (took one year) PD=jan-1999. Our company was acquired officially in Jan 2000. but the attorney never applied for amendment even after asking for it (He just denied saying that it is not required) after that the acquired company changed name in Sep 2000 (total 3 names, old+new+changed). Now recently I applied for I-485. Hope I will not get an RFE but don\'t know what to do. Job itself is not secured.
