RFE for Birth Certificate. Please Help !!!

I have received the following RFE for my BC details. Could someone please point me to a standard letter format which I should send to the INS. Do we have a format here on this forum. Please let me know :


Submit one additional statement, sworn to or affirmed by a person who was living at the time and who has personal knowledge of the events you are trying to prove, for example, the date and place of birth. The person making the statement (affidavit) may be your relative and need not be a citizen of the United States. However an affidavit written by you or the beneficiary is not acceptable. The affidavit should contain the following information regarding the person making the affidavit;

1) his/her full name and address;
2) his/her date and place of birth;
3)his/her relationship to you, if any;
4)full information concerning the event;
5) and complete details concerning how he/she acquired knowledge of the event.
6) The affidavit should address the facts concerning the birth of Puneet listing both parent's complete names.




I think I know what docs are needed. But I just want to make sure if there is a standard letter format for this type of RFE. Please let me know.

I, John Doe, am the uncle of Jim Smith, I am residing at 123 Liberty Street, Washington, DC, USA, I am 60 years of age.

I, John Doe, am familiar with the birth of Jim Smith. Jim Smith was born in Washington, DC, USA, on September 12, 1970. His mother’s name is Martha Smith. His father’s name is William Smith. I have known Jim Smith since birth. I know him to be the person specified in his passport. Passport copy attached.


I, John Doe, certify under penalty of perjury under the laws of the United States that:

I know the contents of this affidavit of proof of birth signed by me;
All the statements in this affidavit are true and correct;
I make this affidavit stated above, freely, and without any mental reservation;

This should be notarized wherever you get it from. Just curious as to why you didn't submit affidavits before ??

Also if you haven't submitted any affidavits, i suggest you submit 2

Following is a format I used for my wife's BC (affidavit from her mother).

AFFIDAVIT OF <Parent name>


I, Mrs. xyz, wife of abc, aged 47 years, now residing at <current address>, do hereby solemnly affirm and state as follows:

1. That on <birth date> gave birth to my daughter, <name> at <hospital name, address>.

2. That I am a <your religion> following the <religion> customs.

3. That the information given above is true to the best of my knowledge.


The above is in reference to the Birth Certificate of my daughter, <name> issued by the Government of the State of <state name> under section 12, 17, Registration No.1132 [change this if you want], dated <date>.

You can get the birth certificate from embassy of India. Contact you nearest Indian emabassy. They will issue you a birth certificate in one day.

That is not valid for GC purpose. They don't accept BC from the consulate. We have seen this in many cases.
 
BC issued by embassy is not accepted.

Also, affidavit has to be from someone other than parents(uncles/aunts acceptable). I submitted one each from parents, a paternal uncle and a maternal uncle. My $0.02.

There is no restriction like that. Biological father and mother CAN give affidavits. In fact most of the people submit their parents affidavits.
