RFE for Birth cert

Hi,

I just got RFE for birth certificate.

Since my birth was at home USCSI didn't like me sending a Birth certificate with Chief registrar of births and deaths. (Form # 9) (Indian version)

They also mention it is late registration and advises me to contact or make verification of birth inquiry from the archives of the Civil Registrar general or National Statistics office in the country and city of applicants' birth. If records are not available then it has to be supported with a letter bearing the seal and sign of an official from the autohorites at the National Stat or Civil authorities indicating the reason of non-availability of such document.

In addition provide secondary evidence like hospital birth certificate or amended birth certificate or school records and affidavits from friends and relatives !!

Can someone please advise what I need to do ?? Thanks in advance

I have also got RFE for BC. I have got BC from embassy recently which has date of birth/ parents name etc. and planning to submit. What do you think is it not enough

Could you give your details.

---------------USCIS doe NOT accept Birth certificate issued by embassy or consulate

You need to provide 2 affidavits from your parents/elders, which should have same birth date, place of birth as on submitted certificate. If you are from India get 2 affidavits from parents on 10 rupees stamp paper signed before executive magistrate or Notary. Also provide the school certificate if it has correct date of birth on it. You need to provide only copies

But how about the "Non-availability of birth certificate". Do I need to furnish that also ? Please can you comment on this ? Where can I get the format ?

Yes I was born in India.

------------- you have submited BC and if you submit Non-availability of birth certificate it will complicate the matter at this stage. you should have submited Non-availability of birth certificate+ 2 affidavits from your parents/elders with your I-485
Yes I was born in India.
--------- in India ask any lawyer to make affidevit,if it is from your mother it should have her married name (can also write that her name before marriage was....) she got married to your father....
XYZ was born on date... at place..... and she is your real mother ( lawyer will write the legal language)
from father, his name, place of his residence, you were born on date... at place......

** you can go to www.immihelp.com and look for sample document and in that sample add the info that i wrote above
** all the info like your name, DOB, place of birth should be same as on your passport

When I submitted I-485 I just provided my BC which is late registration. Now the USCIS doesn't like it .. and asks me to provide Non availability certificate upto that period of registration. I don't know if any government authorities would provide me that info. I am little sceptical about this ..

The affidavits will also go in when I submit the RFE. Right now I am trying to get that from parents back in india.

But I don't understand with your comments about complicating ? Why do you think so ?

----------------------------What I tried to say is that if you now submit non availability certificate then the officer can get confused because you provided late registration birth certificate, if the office that issued you birth certificate can give you letter that XYX birth was registered on date…. and from your (birth date) to the date birth certificate was issued they don’t have any record of his (your) birth certificate then you can attach that letter with affidavits. for more info talk to your lawyer

Apparently I found out that the Non-availability certificate was issued by the Chief registrar to the court before my birth was registered. So ideally I will provide the same document to the USCIS stating that my birth was registered only after issuing the Non-availability cert from the registrar. I will check with my attorneys on this matter

Any comments ?

I also got an BC RFE for my !-485. I submitted it over 3 months ago, but haven't heard anything back from the INS. Anyone know how long they should take to respond?

Did you had the same exact Non-availability RFE that was issued for me ?

How did you submit the Non-availability document. I heard from my parent that they don't give the Non-availability document to us but instead give to the magistrate who will then summon the Registrar to issue a birth certificate.

I don't know how long does it take to issue one more Non-availibility document with a different format :rolleyes:

BTW, Are you in eb3 category ? If yes then you have to wait for the new numbers to be allocated which is probably in Oct

Hi.. i got a similar RFE in early june that i asked me to provide wiht affidavits because my birth was registered late. It used the same wording that they have used in your RFE. I provided a couple of affidvits - one from my mother and one from my father, and it worked. I got my I-485 approved in approx. 1 month.

Just provide them with affidavits from your parents andthat would work.

Are you sure ? Can you send me a private message with the exact contents of your RFE if you have it now ? My Attorneys are pressing me for that information which in my mind is very hard to get since my birth was already registered and that they are not going to provide me Non-availibility cert. now.
