RFE for Birth cert

Birth Certificate issued by hospital

I realized recently that the dilapidated birth certificate I have is not a certificate issued by the municipality, but issued by the hospital. The certificate is original and as old as me, but nonetheless, looks like I should expect a RFE.

Any other cases where hospital registration certificate was submitted with I-485?

If so, what type of RFE might I anticipate?

I did submit the late registered BC.. and got RFE.

I have a similiar BC problem.
The authorities at my place of birth are not giving "Non Availability certificate" directly but they want me come thru the court with a court order and everything. Thats going to take 8-10 months.

However I have got a consulate issued certificate from one of the consulates in the US and notorised affidivits from my parents and uncle.

Will that help? How can I get the Non Availability from my place of birth?

Pls help me to find a way out.

Under Section 17 of Registration of Births and Deaths Act, 1969, anyone can initiate a search for birth. If no record is found the registrar, will then issue a non availability certificate.

Have a question here. If one produces a "Non Availability of birth certificate"
along with the supporting affidivits, wont the USCIS ask "how you were able to complete colege education and also can get a passport without a birth certificate?"
When my people in India were trying to get a Non availability certificate from the Municipality, this was the question asked by the municipality.

Pls provide some suggestion on this. Anyone was asked this question by the USCIS? If so, how to tackle?

Can't say about others, but I was not asked this question. If you were born before April 1970 (if I remember correctly), you most probably will not be asked this question because registering birth was not mandatory in India before 1970. The secondary evidence of birth (affidavits from parents, school certificates, etc.) will be considered by USCIS only when you submit this non-availability certificate.

As I said, talk to your lawyer because the information mentioned above is based on my own experience and may not necessarily apply to your case.

I am asking this because along with I 130 we need to furnish the BC of the petitioner and not the beneficarys Birth Certificate.

So are all these RFEs on I 130 because the petitioners Birth Certificate was registered late.

This is about the beneficarys. In case of I-130 You can produce naturalization certificate in lieu of Birth Certificate
