Friends,

Was checking the status of the AP application filed in May and saw that a RFE has been sent. Dont know the details yet.

Has any one else also got any RFE's and if so, what were they for?

TIA,
Anitha

It may be for I-140

Hello Anitha:

I think, you need not worry about the RFE, as they had asked for my spouse's case last year as well. They had asked for the underlying I-140 and once we mailed it, hers was approved.

I have an RFE issued on my AP case (Apr. 2003). Due to messup with address change, the mail went back to local INS office and now is at my old lawyer's office. As per lawyer's office, I should have it tomorrow to find out what the deal is. It could be anything from

- Why I didn't register for special registration (Advance Parol)
- Address Change
- I-140

I will let you know as soon as I find out.

BTW, this is my 3rd AP. You wonder why an RFE now! But I am sure there is some hidden good in this as well. Maybe, they will work on my pending 485 now!!!

I checked the status of my wife's AP application this morning - CIS issued an RFE yesterday. Her ND is May 14. It looks like that CIS is processing May '03 cases now.

I guess it’s RFE season for AP
TSC is doing all kinds of system testing

Backlogs
mutiple FPs
REFs
never change online status
missing files
3 digit processing date (soon 4digits)

Here is what the RFE on my AP (Apr. 18, 2003) says:

"Upon search of the Service System(s), there is no evidence there is an underlying I-140 or I-360 on file to warrant a valid I-485, Application to Adjust Status, that would make you eligible to receive advance Parole."

Go figure why the I-140 is not on file for the 3rd AP!!!

BTW, both the Last name and street name was spelled incorrectly on the notice.

According to TSC director, Ms. Upchurch, their "systems" use the Last Name of the applicant as search criteria. If the Last Name is spelled differently on different documents (I140 approval, Birth Certificate, Marriage Certificate etc.) there is no way for them to get a successful match and a RFE probability is very high.

Important note for everybody: Stick to one spelling of your Last Name for all communications with TSC.

Apparently the A# is just a supplemental piece of information and is not used as a key data field - another evidence of the obsolete and inefficient TSC working environment.
