RFE for AP!!

Hi,

I have received an RFP for AP!! To say the least I was'nt expecting this.
They have asked for "emergent personal reason or a bona fide business reason to travel".

I have multiple reasons to travel, but am not sure, what kind of proof will convince them.

Does anyboday has had this experience, any suggestions what kind of "proof" would be sufficient ?

Too bad . This is going crazier. What do they expect us not to leave US until they can decide our 485 cases??

Anyway what is ur AP RD/ND?

Did you submit a reason for travel letter alongwith your application?
 
Did you, in the first place, miss sending a letter w/ reason for applying AP...That's the RFE for..I guess

Dont need to send a letter with the AP application. I applied thrice and never sent any letter.
 
I received one too

My wife, children and I received the same RFE for AP. My lawyers are handling it . They informed me that every 485 applicant is eligible for AP and they will send the response to RFE. Their take was that it was a newly "trained" IMO who may not know the entire process.

what kind of RFE is that for the AP???

what the heck ?!%$#!

you should reply:

1. without AP, i cannot travel.
2. check your handbook, i am eligible for the AP without specific reason.
3. your I-485 processing time are getting untolerable time-consuming, if you could approve my I485 now, i don't need to apply the AP.
4. you should do something to reduce the backlog rather than sending me this useless RFE...:D

No I did not send any letter. (Neither did some of my other friends who got their APs without an RFE.) My lawyer never told me about the letter.

So this seems to be a random act of cruelity..

It was a shocker for me, as I did not think that an RFE can be issued for an AP.


Happyperson-- Technically , the USCIS can issue an rfe for ap.. I found this on their website :

Aliens in the United States should, prior to departure, obtain Advance Parole in order to re-enter the United States after travel abroad if they have:

-Filed an application for adjustment of status but have not received a decision from the USCIS;
-Hold refugee or asylee status and intend to depart temporarily to apply for a U.S. immigrant visa in Canada; and/or
-**An emergent personal or bona fide reason to travel temporarily abroad.** Applicants who are the beneficiary of a Private bill and Applicants who are under deportation proceedings must file to the Department of Homeland Security, 425 I Street, NW, ATTN: Parole and Humanitarian Assistance Branch, Washington, DC 20536

So if anyone of you knows what documentary, evidence is required(other than the letter, which I will surely send now.. ), do let me know.

Daj, My RD/ND for the AP was around August end.
 
I've used the following paragraph in my AP renewal cover letters:

Explanation for requesting Advance Parole:
As adjustment of status applicants, my spouse & I kindly request the issuance of the Advance Parole Travel Document to enable us travel to India where our parents live. Due to their old age and failing health we might need to visit India at short notice.

my husband applied for his n my EAD and AP and I485 in july.. the RD was july 31.. his I140 is still pending from last year july 2002; And we havent heard about the EAD and AP yet.. the only notice i got a few days bak was that my case is under review please wait for 60-90 days :( how long will this wait be?? i had ticket for the 21st of Dec and had to cancel them since there is no sign of AP.. contacted the local congress in Milwaukee and she gave me the same reply" ur case is under review"" what the hell is going on here :(:( someone please advice.. also milwaukee office doesnt give walk in iEAD.. anyone had an experience???:( case filled in VSC because husbands company is there..
