RFE - employment history - Urgent

Hi,

name and location of employer : not an issue
job title : not an issue
position : not an issue
Dates you held each position :
The start date is "first time landed in USA" + two months.

So which date should I say here ?. The appointment letter also says that the start date is first time landed in USA (I94 date) + two months.


in the same rfe I have to profide the support documents for maintaining the status since I have landed (I94).


Since I was on bench for the first two months, will it cause any problem to my GC ?

submit a list describing your employemnt history since your last lawful admission to the U.S. this list shall include the name and location of each employer, the job title(s) and dutiues, the educational/training requirements, the dates you held each position and the salary/wage paid


RFE # 2

please submit the proof of your continious employemnt authorization/maintaining status in the U.S from xx/xx/xxxx to xx/xx/xxx. such evidence may include copies of

- .....I-94
- ....I-797
- passport visa


Since I was on bench for the first two months (first i-94 entry date + 2 months), How do I reply for the above two RFEs

Just reply with the truth and supporting documents. It is unlikely the 2-month gap would affect your I-485. It is below the 180-day tolerance, and it would normally be the employer who is penalized for benching (with fines and back wages), not the employee.

let the company lawyer to prepare RFE reply and let the employer explain why they did not pay you for two months.

I wouldn't have them say anything about the first two months, unless the USCIS was specifically asking about those two months. Best to just list the dates as they are, and don't draw attention to them unnecessarily.
