RFE - Changed jobs - AC 21 not filed

I recently changed job (I140 approved and 485 > 180 days). However, I did not file for AC21 :o as my new company told me that it is not really required. I am on excellent terms with my original employer (the one who filed my I 140). I got an RFE on my 485 :( . Here are the details of the RFE that my lawyer sent to me

  1. a letter from my previous employer stating their continuted interest in hiring me, the duties to be performed and remuneration
  2. Latest W-2 tax form
  3. Copy of most recent I-94 arrival document

I spoke to my previous employer and they indicated that they do not have any problem giving the letter.

Am I in trouble? Please advice. :confused:

So what you are saying is that I can still use AC21? If I do get a letter from my 140-filing company (which they are ready to provide), how long will I have to work with them. Do I necessarily need to work with them?

The reason I am asking all these questions is because, my current employer is not a big firm and they do not want to get into all these hassles. However, my 140-filing company is ready to do me this favor.

Please advice.
 
GC is always for the future employment and since you are getting your GC from your sponsoring employer, you will have to work for them once you get your GC. And if you don't join them then you will have to justify why you didn't work for the sponsoring employer after getting GC when you apply for Naturalization.
