RFE cases: what is the percentage?

Hi, All:

I am posting for the first time after being a reader for over a year now. I want to first thank Mr. Khanna and the forum moderator for maintaining such an informative site.

I have a few questions regarding RFE, and I would appreciate any comments:

1. Percentage of the RFE cases

I have noticed that some ppl get RFE while others don't, I was wondering about the percentage of the I-485 cases that get RFE. Do you think it is more than 50% or much less?

2. what is a pay stub?

One common RFE item is pay stub for 1-6 month. What exactly is a pay stub, is it a slip kind of thing that comes with every paycheck with the salary/tax/deduction information on it? Or it is a document that should be prepared by the payroll office?

3. How recent the REF pay stub has to be?

For example, if I receive a RFE for pay stub on March 1, 2003, is it ok if my lastest pay stub is Feb, 2003?

RFE percentage is much less than 50%. Maybe 15%, depends on ur type of case. Normally EB2 or EB3 have more chance of getting RFE for paystub and employment related issues. All applicants have a chance of getting RFE for non-clarified personal documents like birth certificate, marriage certificate, medical, etc. IF you prepare your documents carefully, your chance of getting a RFE is much less.

Paystub is exactly what you described. Or, in case the company offers electronic paystub, you can log in to your company's payroll website and print out the paystub there. As long as your paystubs are the latest paystub you can get, don't care about Feb or March.
 
2. Yes you are right, it is the statement of wages that comes with paycheck.

3. I think if you get an RFE on March 01, the most recent paystub can't be anything later than Feb.

What in your opinion for EB1 cases? Are they processed faster, no RFE ? You are a EB1 case yourself
