My lawyer received the following RFE.
--a list of all I-140 Petitions filed with the Service Center for the years 2006 and 2007. The list should include the following; receipt number, name & date of birth of the Beneficiary, proffered wages for each Beneficiary, a copy of each beneficiary's labor certification which indicates their priority date.
--company's annual report, U.S. Tax Return (including Schedule L) or a third-party audited financial statement for years 2005 and 2006.
--W-2s for each year that xxxx has worked at xxxxx
--xxxx's three most recent pay vouchers
--copies of all of xxxx's H-1B approval notices. We have one H-1 Approval notice for him, valid from xxxxx to xxxxx.
The response is due to the Service Center on xxxxx, 2007.
The company has not yet filed the tax returns for 2006. They have filed for extension. Can the RFE be replied to using the extension document, and all of the rest required documents above?
Any body here who has had a similar case?
