most serbian males who had asylum approved in the US (second half of 1990s) got it because they were unwilling to serve the army and were unable to return there because court persecution was imminent. on april 19 serbian government voted in an amnesty law which forgives all males and guarantees freedom upon return to serbia. I would like to know if the US would possibly revoke our asylum status now especially to those of us who still have I-485s pending.

any thoughts? information?
thanks

I can only express my opinion. I think the answer is NO. Plus all those people probably already a GC holders anyway.

It's pretty much the same as with guys from Afganistan. After American invasion nobody's asylum status was revoked. Don't be afraid. I am sure the answer is no.

They have the legal power to review the asylum files due to this development. But I highly doubt that they will.

There has not been a massive revocation due to changed conditions in a long time. The last time was in the early 1990s.

You will be fine, even that your application is pending. And you can also travel back without any problem.

Congress is debating given amnessty to illegal aliens. So there is need to worry about revocation of legal aliens. Also remember that you have lived here for long time about twenty years. That is self is ground on which protection can be given to you because you absorbed alot of American culture...so returning your country of origin would certainly cause a hardship....Any I think think you should worry about your asylum.....just applying common sense..

What was the precedent?

In 1990 the world was undergoing dramatic geopolitical changes. The Iron Curtain fell in Eastern Europe; the Communists were defeated in Nicaragua; the American Marines installed a new government in Panama.

So the INS announced that they would terminate the asylum status of people from those countries and ask them to leave the United States. Congress thought this was too draconian and passed a law preventing the INS from proceeding further and reinstated the status of people ordered deported. Note the law does not prevent the INS from revoking in future cases. But then again the INS has tried this again.
