This is so clever! If my interpritation is right, they can still approve/allot visa numbers to the pending cases, but cannot accept new cases -

Effective Monday July 2, 2007 there will be no further authorizations in response to requests for Employment-based preference cases.

Why the hell AILA blames USCIS for alloting visa numbers to the existing cases? All they want is to mint money, they want us not to get approved so easily! Hope they cannot argue about it now.

What a political game everyone plays with us, either way we are the victims.
 
Can you be more specific about how you can interprate "they can still approve/allot visa numbers to the pending cases, but cannot accept new cases".?

I don't see any thing specific which supports your inteprataion in revised bulletin.. sorry If i am not getting bigger picture here..

When after waiting 5 years I see some light from USCIS, now AILA wants to screw us again. Unite against AILA and ask them to just shut up.
 
I agree - AILA is worried because the attorneys can't generate any revenue through new I-485 filings till Oct 1, 2007.

They don't care whether the old cases get approved or not since they (most of them) charge on a flat fee basis.

AILA does not have any altruistic motives here:-)

I could be wrong but the July visa bulletin still says "Current", so techinically they can approve pending cases and they say the bulletin should be read in conjunction with the update which says

Effective Monday July 2, 2007 there will be no further authorizations in response to requests for Employment-based preference cases.

Doesn't it sound like this refers to the new requests? I am not an expert but that's the conclusion I want to come to... Any insights?

It all Depends on Them the USCIS..

We can do interpretation in many ways.. but finally they USCIS and there useless procedures.. only do the work..

and now AILA one more tangent to the whole thing.. they cant just shut up there Axxx and keep quite ? already things are in mess and these people.. make it more messy..

AILA has many Lawerys in there team.. and they dont have any brains to use? now it is ok.. AILA will put a law suite against USCIS.. but later they are not thinking that USCIS are the people.. who process there applications.. and USCIS can hold or can do any thing on the new applications for ever.. right? and then AILA will not fight for any thing.. and keep quite.. and listen what ever USCIS say.. That check this check etc etc.. for applications ( as they would have got there Fees ) and reply back to applicants the same.

AILA wants to make some fast bucks and screw up all the applications at USCIS both Old and New ones..

Horrible.. AILA and any way.. I-485's are Indivisual Applications.. yeah.. only people who know to read and write can handle themselves.. I know there are people who go to AILA Lawyers..

Any way it is Fun here also.. to watch..

I have forgot about my GC and dont know when this comes also.. will watch fun..
 
Generally, DOS authorizes USCIS requests for Visa number allocations for any 485 approvals based on Visa bulletin for that month.

I think this July 2nd game was well planned by DOS & BCIS and executed perfectly. The point is, they have to utilize all available Visas for this year and they know that that is possible only when they should be able to approve cases irrespective of category, PD & country. (They don't want to do much analysis on what's latest PD in pending cases and by each category & country then decide the current PDs. I don't believe they have this capability considering their broken processes & decentralized systems in place).

So ealiest way is make all categories current and request for a visa number for all approvable cases irrespective of PD, country, category by 7/1 ( technically DOS can allot last quarter visa only in the last quarter and that too with no country limit).

So BCIS approved as many cases as possible in June and also worked over the weekend (6/30 & 7/1) and requested for new visa numbers from DOS and then DOS flipped the card with SOLD. The USCIS issued a notice saying that it would reject all Employment based 485 filings effective 7/2/2007 ( of course, to make more money with new fee structure after July, in this case after Oct).

So I hope we will see few approvals till october 07 for the cases which visa numbers already been allotted.
