Revalidating H1 Visa !

Hi There ,

Thank you all for this really usefull forum.

My problem is as follows : I am on a H1B visa for the past 2 years and I am currently working for a company here in the usa.

Last year I did transfer my visa from my previous employer to my current employer and I had gone to Vancouver BC for my new visa stamping and had a tough time- they refused to process my visa -the entries on my passport were a bit faint -but was readable - i tried explaining that all indian passports are handwritten and overtime the entries do get faded - but they did not listen and they finally gave me an authorization to return to the consulate later with a newpassport . I tried getting backto the US ,but at the border the INS guys did not let me in- so I returned back to vancouver , and then had to get a new passport from the indian consulate in vancouver and then got my new visa stamping from the US consulate and then returned back to the usa ..whew it was quite an ordeal.

Now I have got my new visa extension and I am planning to get the new visa stamping by POST (sending my passport to washington DC) and I am really not sure about what I must put on(Yes or NO) my DS-0156 form ITEM 31 and ITEM 38 - part2 question. For ITEM 31 - I was not refused a VISA ,as they processed my visa after I got my new passport . ITEM 38 - I am not sure as I was sent back from the border , they did not cancel my visa or anything , but sent me back to vancouver.

You need a new visa stamp in your passport only if your current visa has expired or is expiring soon. H visas are valid until expiration even after you change employers. All that you need is a valid H1 approval notice and a valid H1 visa stamp in your passport.

Thank You for the reply. I have another question ..can i apply for a visa stamping only if my current visa expires in 60 days or this does not matter ?

You can apply if either:
the visa is expired,
or it will expire in 60 days.
 
Visa Stamping in Canada

Hi Ruby,

Congratulations for getting visa stamped after lot of effort.
We are ( meH1 and my wife H4) also planning to get visa stamping in Canada. Could you let me know what are the documents and questions they asked. How long they took to finish entire process? Do we need to take appointment before going there???? Now a days it's taking more than 3 months for visa stamping in DC.
