I have a question for you all. Currently, I am a citizen of India. However, my father is a naturalized citizen of USA (but my mother is not). When I was a minor (7 years of age), we visited the United States (later I learned with the intention of settling permanently). My father applied for a green card for my mother, my brother, and me, which we subsequently received, along with our alien registration numbers. These were issued in the year 1989, something that I would learn only later.
However, my father did not want familial responsibilities, and hence, did not want to stay together as a family. While in the United States, my mother was never given her green card, something that should have been with her rightfully. We as minors, were naturally not aware of the happenings. My father asked us to leave for India, and pretty much, stay here. This year, after many years, he visited us, and that is when he mentioned that we had green cards back then. I was completely taken aback, for all this while, I was under the impression that in the past, we had only gone *for a short visit* to see our father. Needless to say, I feel cheated, and wronged. I visited the United States (using a B1/B2 visa) earlier this year, and after speaking with some friends who live there, I got to know of the returning resident visa.
I understand that being a minor, I had no *willful control* in having abandoned the resident status in the past. Today, I feel a strong need to apply for a returning resident visa. But I am confused -- how do I do this? Like I mentioned, we do not have our green cards. However, we do have our alien registration numbers with us. Also, what sort of chances do we stand in expecting a just ruling? Can anyone please advise? Thanks in anticipation!
