I have received an RFE for my I-131 application:

"Service records indicate you have a travel document expiring December 25, 2005. Please attach your old travel document. You must return your previously issued document, before we may continue adjudicating your present request. If you no longer have your previously issued document, please explain."

Want, remember? Few months ago you answered my question and told me that it is unnecessary to return the old RTD when applying for a new one. Did you conclude this from your own experience? It seems not true at least in my case.

Since I’ve just received my green card, I may not need to renew my RTD. What is the travel document for green card holders? Can I withdraw this I-131 application and ask my fee back?

Thank you!

You cannot get your fee back as it is not refundable.

The instructions to the form state very cleary that you cannot have two valid documents at the same time. In other words you have to return the valid (expiring) one before a new one can be issued to you.

Some officers have not enforced this rule. But it is a minor gamble if you submit an application and keep the original document.

It is useless to hold two valid RTD. In my case, if the current RTD expires on 12/25/2005, they can issue me a new one on 12/25/2005. I wont need the new one until the old one is expired. Why I applied 1/2 years ahead is because the application procedure currently takes 6+ months to implement.

If I give them the current one, what can I use now? I will lose the freedom to travel from application date to 12/25/2005. I paid it for 1 full year, not 1/2 years.

It is not a fair game. Get it?

Sadasylee, do what they say. I got my new RTD while other one was valid for another 15 days or so. I had 2 valid RTDS in hand..and I didn't expec thta... I think it really depends on the officer. You will lose your fee so better you get what you paid for.

yeah I don't know whats the mystery with this LUD change??/
They touch the file and then disappear....

i used to apply RTD for a couple of times, and i only sent them the copy and keep the original because its still valid for least 3-4 months (i have to apply 3-4 months in advance) i never had problems
so i guess it depends on the officer who processing your application.

actually a funny story: when i travel to canada, i actually show the officer my 2 valid RTD, one expired RTD with valid canadian visa , the other is my NEW RTD....the officer told me to apply another canadian visa on my new RTD, but he did not take my old one away :D
