Return with AP but no visa stamp

ThanksToGod

I lost my pasport and I-94. and got a new passport without original visa stamp. Can I return using AP and this new passport?

Thanks

I guess it should be possible.

Consult a lawyer. But my 2 cents is that with AP you should be able to be back. Reason AP is most often a replacement synonym to H1-B visa (or any visa with pending GC/AOS)

jaxen - we would miss you!!

visa is required

None of the documents, H1, AP, etc are a replacement of a visa.

If you board from India, I do not think they will allow you to board the flight, without a visa stamped on your passport.

I think you will be required to visit the embassy for stamping before you fly back, especially if you are from India.

Req of Visa and AP -- May be and may be not!!

Well, I guessed this because of one of my friend's case.

* She came here on H1-B visa.
* Got married to a GC holder.
* Applied for GC through family based immigration
* She lost her job (and the H1-B... needless to say it was cancelled).
* She had her pending AOS. She got an AP (advance Parole).
* She travelled to India and was back (that too, many times!!).
* She finally got her GC a month or so back!!

I'm not sure how she could do it and I presume(d) that it was AP. I may be wrong. But will update after talking to her.

Meanwhile, this is an interesting article on advance parole.

(As always the legal disclaimers apply)
