So, due to retrogression one cannot file I-130/I-485 concurrently or I-140/I-485 concurrently to avail the benefits of EAD and AP? Dates were backlogged for family categories for ages and so for example if a spouse is in the US on visitor visa, can his/her spouse who is an LPR not file for I-130/I-485 immediately? Should this spouse wait for the prority date to be current to even file I-485 to avail of EAD and AP? I am little confused here.
