Retain Priority Date!!

Needed some advice please...

I have an approved EB-3 I-140 from Nebraska SC with a PD of Jan 2002 from my old employer and I just got I-140 from my current employer approved in EB-2 with a PD of June 2005 from Vermont.

I have read about the rule which I could use to retain my older priority date. The I-140 from my previous employer has not been revoked.

Could someone please help me with these?

1. Any one has the exact verbiage/link to the rule which allows retention of the earlier PD?
2. Any format of the letter that they has been sent to the Service Centers for the retention of the PD based on an earlier I-140?
3. What address should I sent the letter to in Vermont DC?

Any help is greatly appreciated. (My attorney is an **** and no help can be expected from him).

I have same problem.
I have an approved EB-2 from NSC with a PD of Aug 2003 and an approved EB-1A from VSC with a PD of Dec 2004. My I-485 linked with the EB-1A I-140.
May I use the earlier PD (EB-2) for EB-1category? Thanks.

Yes you can retain the Old PD

Yes, You can retain your old PD if your previous employer or USCIS did not revoke your approved I-140. Go to www.murhty.com and search for an article on retaining the old PD. Nebraska service center had given instructions on how to claim and what kind of letter should be written to get the old PD. Old PD is interchangeble in all EB1, EB2 and EB3 category but can not be extended to Family category.
