Response to I140Rfe and consider CP processing??

I got RFE one week back based on my I-140 and I485 concurrent filling, When I response to my query and send a letter saying that I would like to consider for the Consular Processing then what will happen to my pending I-485, EAD and AP??

How many days it will take to cancel my I-485/EAD/AP once I respond to my I140/RFE??, Again After I respond I belive my I-140 will be transfered to NVS center ...so after that what will happen>???...Please advice??

CP options is chosen at the time I-140 filing. If you have already applied for AOS and want to convert into CP. You need to file I-824. Once I-824 is filed you have two options Either wait until I-824 approval or Apply for AC-140. AC-140 is fast as you need not wait for I-824 approval. But all the consulates does not accept AC-140. You need not canel your I-485. Apply I-824 will take care of that.

I do agree with that but I would like to consider the CP-Processing by filing I-824 and AC-140 but the thing is when we reply RFE along with I-824...will they not consider the CP-Processing immediatly and how long does it takes to cancel my I-485???

----------If you have RFE for I-140 better only reply to RFE and once your I-140 gets approved and lawyer gets I-140 approval notice then file I-824, dont mix the two things at same time RFE for I-140 and filing I-824 it may complicate.

By I heard that my 485 will be cancelled only when I-824 is approved and not received..is this correct??


Once I send I-824 to USCIS how many days will it takes to cancel my I-485?, If I used AC-140 along with I-824 will that be O.K.?


I heard from his forum, Even though I file I-824 and received by USCIS, my I-485 will not be denied but USCIS may send the letter to request for deny or not and once I response to that then only my I-485 will be denied right??, Will this also deny dependent I-485?? automatically??


Will USCIS will send a seperate letter to both the I-485 primary and dependent that the I-485 will be denied as the primary has requested the CP Processing with I-824??


Once I file I824 will I have to file any dependent information??

---- From where did you heard? You must ask your lawyer. The day USCIS receives I-824 your I-485 will be abandoned. FYI I-824 takes about 1 year to be processed and I-485 does not stand for the same time. You file I-824 and I-485; EAD AP all will be abandoned

--- AC1-140 is used with I-824 filing receipt not all the consulates accept AC-140. Some consulates need I-824 to be approved. But you have RFE on your I-140 and you don’t have Approved I-140 at this time, pray that I-140 gets approved

**** You have posted the same few days back and you need to discuss with your lawyer. your I-140 has RFE and you are thinking about AC-140 without I-140 approval.
