Resident since date on PR Card

Hello all,

Does any one remember when you go for passport stamp after I-485 approval does the IO give you back the approval notice ?

The reason I am asking this question is my LPR card says Resident since date: 05/21/2004 but I went for passport stamp on 10/30/2004 and IO wrote that date in the passport. Apart from the card I dont have any other proof that USCIS approved my PR on 05/21/2004. If the IO gave me back the approval notice, then I sure lost it.

Now I applied N400 based on Resident since date on PR Card and I am wondering they may deny it for applying too early because the passport has 10/30/2004. I read from one of the posters here that his/her N400 got denied because their records has later date approval for 485 than the PR card ...

Yes, some times the GC is issued with the wrong resident since date. If you applied based on a wrong date on the GC which is earlier than the real date the application will be denied if the IO catches that, and if the IO doesn't deny you'll probably worry that this mistake can be caught later. Anyway it's probably better that it is denied for your overall peace of mind.

You probably should have made copies of the approval notice. I don't think the IO gives the original form back. Is it possible you have another way of finding out what the correct date was?

By the way, according to earlier posts from you it seems you got your GC on June 22nd 2005? Which is the correct information?

Did you check the case status online, using the I-485 receipt number? If yes, what date does it say for mailing the card or approval notice?

Was your priority date current in May 2004? Did you have to do an interview for your I-485? If yes, was the interview on or before May 21, 2004?

Sometimes when you interview for the I-485, the I-485 is actually approved on the same day or a couple of weeks later, but then USCIS takes a number of months to transfer the files back to the service center and order the card production. In such a scenario you could end up with a card that has a "resident since" date which is a number of months before you received it, and the date on the card is legitimate.

you could have gone for the stamp much after your approval. I would go for the date on the card. How can they hold that against you?
 
They can and they will. The really important date is the approval of the adjustment of status. People have gotten N-400 denied because of applying based on the wrong date printed on the GC.

I did not have interview for the 485. I am not sure about the online status I don't remember. I do remember getting the approval notice in sept or something with notice date of 05/21/2004. In july or so my attorney called USCIS about my Advance Parole and got confirmation that 485 got approved on 05/21/2004 and that's why AP got denied. That much I remembered.

Sorry for the confusion ... my spouse got the PR in June of 2005 and mine in 2004.

Dedo, Thanks for the kind words but Huracan was right .... unfortunately with USCIS we will pay for our mistakes as well as for their mistakes.

My only hope is that they kept the approval notice I gave for my passport stamp on 10/30/2004 (which has the notice date of 05/21/2004) in my A file ... Lets see what happens next month when I have my N400 interview. At this point I cant do much since the app fee will not be refunded.

Any other thoughts or comments?

-----------------IO wrote 10/30/2004 becase he gave you passport stamp on that date and you went to local USCIS office for stamp on 10/30/2004 .

You don't have to remember. If you have the I-485 application receipt, you can enter the case number now and find out what it says online. The case number is also listed on the fingerprint notice. And if your green card has a similar format as mine, that case number would also be on the front of the green card itself (see the the 13-digit alphanumeric code, 3 letters followed by 10 numbers, on the right side of the first line of three lines of codes on the bottom of the card.)

I didn't think they keep the online status this long .... another interesting note is that the online profile shows the record was last updated on 10/25/2008 ???
 
So you still don't have anything except the card that confirms a May 2004 approval date. I guess all you can do at this time is wait for the interview and see what happens. If denied because the card date is wrong, ask them what the right date is and reapply when you are eligible. Or maybe you can convince them to give you a "continuation", which would involve a second interview after your true 5-year anniversary, without having to spend the money to reapply, since after all it was their mistake that led you to apply as soon as you did.

Unfortunately No. At this time I couldn't find a copy of the 485 approval letter. And the attorney office (paul hastings) sold the immigration practice to some other firm and i cannot get hold of anyone from previous contacts (they probably left the firm) ...

I am still waiting for an answer from the forum members who went for passport stamp if the IO kept the approval letter or gave it back .... I am hoping they kept it in my A file but lets see how the interview goes next month.
