Resident or non-resident for tax purposes (former H1B holder)

I worked with an H1B visa and paid taxes for 4 years: from 08/2001 to 08/2005.

I've been a student with a F1 visa from 09/2006-today.

My only income is the stipend that school is paying me every month plus some interest I am getting from Emmigrant Direct.

I believe during the 4 years while I was employed I was a resident alien for tax purposes.

What am I now?

usually in the first five years in F-1 status you are supposed to file taxes as a non-resident. However, I think that assumes that it is your first time entering the US. You should probably ask somebody at the International Office. Or IRS.

Re, H1B and F1 Visa Taxes

Hey

I was in H1B and then moved on to F1 to do an MBA.

In F1 you are considered a Non Resident Alien, as you come under Tax Exempt status for the period of the stay, upto 5 years.

You have to file Form 1040NR-EZ and Form 8843.

I did my Non Resident Taxes at http://www.VisaTaxes.com

I would say you consult the Non Resident Tax Experts at http://forum.VisaTaxes.com, just to make sure.

Hope it helps!
