HI

What are the issues that may occur if I have my (Primary applicant) FP done and have my wife's ( dependent applicant) FP RESCHEDULE at a later date. Will there be any issues in getting the 485 approval for us/ interview for us.
I want to find out out the cons of it, if it is risky then I will call her from Australia. We are Indian citizens and she is on a vacation to Australia.

With Thanks

Hi

It is advisable not to reschedule the appt. as it can delay the approval for your wife. Also, I believe that you need not reschedule if you can go for the FP within 90 days of the appt. You may want to confirm it with your local USCIS office.

All the best.

Thanks Winny,

If it is 90s thing then It will not ben issue, Will reschd ( if required) in any way affect MY approval?

I did exactly that as my notice said to make it on that date or reschedule. I got the appt date of 11th Sep for both spouse and self. She is coming back from abriad on 19th Sep so I sent in a request for reschedule. I had to send the original back. What I plan to do however is take the copy which the lawyer rcvs and go after she comes. I too have heard of the 120 day rule but nobody is willing to confirm it, so to avoid any risk I asked for reschedule for her and will go and do it on lawyer copy.

UNCSYS's lawyer had also asked for a postponment too. He got the reschedule for a month later and he just gave his FP twice as he went once and gave it on the expired notice.

When I was there on Saturday in Brooklyn, NY those guys kind of just visually scan the form I don't know if they really check the appt date.

I do not think her having not done the FP has any bearing on your approval as such. It may delay hers.

Rgds,

Yeppo
