Request USCIS to expedite case

All, I'm stuck in name check and am on the path to a WOM.

I've written to my senator and congressman and also sent out a FOIPA request.I have an infopass appointment coming up in about 10 days.

I also want to send out a request to USCIS requesting them to expedite my case. Expected outcome - denial of request.

Has anyone put in such a request? What is your experience in this regard?

nj_skm,

Can we file WOM on our own ? or do we need employer's support ?, my lawyer will listen to me but by employer may not cooperate for any writ against uscis.

USCIS has 2 established criteria for expediting - search their website. One has to do with Army posting and the other one is on a humanitarian ground (sickness / death / ....) - I am not a 100% sure - I had checked 18 months back. In short - this is a dead end in my view and I had not pursued this.

cksrp, you don't need your employer's support. For that matter, you don't need your attorney's support either. You can file on your own. Do a little research and save yourself a few thousand $$.

dl1cd, I know this is a dead end. I just want to go thru this futile step so that I can use this as one of the supporting documents when I file for the WOM.

I don't have a humanitarian crisis but that doesn't mean that I'm gonna lie back and relax while the FBI take it's own sweet time to get my case processed, which might be a few years.

I know the FBI and USCIS don't see it the same way and hence the WOM.

I've sent my FOIPA today. Hopefully I'll have the response by the third week of Jan.

Before I begin, sorry to say (and as you also know ) that your case is stuck in name check, so it may not help to send in an expedite request to USCIS.
To answer your question, yes we sent in expedite request for my wife's 485 approval. We did not receive a response for the request directly but the case was approved in a timely manner. You can read more about the actual request in this post:

3. If WOM case filed against USCIS, they would also expedite all the background checks

All, thanks for your responses.

As expected, I can see that putting in a request for expediting is simply useless.

But I think I'll go ahead with it for two reasons:
1. It's a no lose situation (I expect them to deny the request).
2. More importantly, this will be another document in my arsenal when I go for a WOM.

I'll wait for my FOIPA results and my infopass and then send in the expedite request, citing the "No record" result from the FBI (assuming that it *does* come back as a "No Record").
